other carrier without written permission from the person <br />operating such terminal or carrier. No taxicab stands <br />shall be provided upon the streets of the city. <br /> <br />No ambulance owner, operator or driver shall solicit <br />passengers at the scene of the accident unless the <br />same has been summoned by telephone communication, <br />and no ambulance shall go to the scene of the accident <br />discovered by monitoring short wave police calls. <br /> <br />Section 38-67. Vehicles and Drivers Licensed Elsewhere. <br /> <br />The operator of a motor vehicle licensed by any juris- <br />diction as a taxicab shall be deemed, upon soliciting <br />passengers in the City of Santa Ana for transportation, <br />to be operating for hire. A person licensed as a taxi- <br />cab driver by any jurisdiction who solicits passengers <br />in the City of Santa Ana shall be deemed to be operating <br />for hire. <br /> <br />Section 38-68. Penalty for Violation of Chapter <br /> Provisions. <br /> <br />Any person, partnership, corporation, firm, registered <br />owner, or holder of a Certificate either by himself or <br />through his direction, consent, assent, permission or <br />acquiescence who shall violate any of the provisions <br />of this chapter, shall be deemed guilty of a misdemeanor. <br />Any person who shall aid, abet or assist in the violation <br />of any of the provisions of this chapter shall be deemed <br />guilty of a misdemeanor, and each separate violation <br />shall constitute a separate offense, and each and every <br />day the offense is continued in cases where the offense <br />is a continuous one, shall constitute a distinct and <br />separate offense. <br /> <br />Section 38-69. Authority to Arrest. <br /> <br />Every police officer of the city is hereby given <br />authority and is enjoined to watch and observe the con- <br />duct of holders and drivers operating under this chapter. <br />Upon discovering a violation of the provisions of this <br />chapter, every such officer shall take immediate steps <br />to enforce the law, by report to proper officials, by <br />citation, by arrest, or by impounding vehicle used in <br />the commission of a violation of this chapter. <br /> <br />~-~_ection 3: If.any section, s~bsecti~n, sentence, clause, <br /> I~ ~ portion of this ordinance is for any reason held <br /> to be invalid or unconstitutional by the decision of any <br /> court of competent jurisdiction, such decision shall not <br /> affect the validity of the remaining portions of this <br /> ordinance. The City Council of the City of Santa Ana <br /> hereby declares that it would have adopted this ordinance <br /> and each section, subsection, sentence, clause, phrase or <br /> portion thereof irrespective of the fact that any one or <br /> more sections, subsections, clauses, phrases or portions <br /> be declared invalid or unconstitutional. <br /> <br />-30- <br /> <br /> <br />
