ORDINANCE NS-1184 <br /> <br />AN EMERGENCY ORDINANCE OF THE CITY COUNCIL <br />OF THE CITY OF SANTA ANA REPEALING CHAPTER <br />38 OF T~E SANTA ANA MUNICIPAL CODE AND EN- <br />ACTING A NEW CNAPTER 38, ENTITLED "VE~ICLES <br />FOR HIRE" REQUIRING A CERTIFICATE OF PUBLIC <br />CONVENIENCE AND NECESSITY FOR THE OPERA. ON <br />OF SUCH VE~ICLES, AND PROVIDING FOR THE <br />ADMINISTRATION AND ENFORCEMENT OF SUCH <br />ORDINANCE. <br /> <br /> THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN <br />AS FOLLOWS: <br /> <br />Section 1: This ordinance is declared by the City Council <br />to be an emergency measure necessary to preserve the public <br />peace, health, and safety. <br /> <br />Section 2: The City Council finds that the reasons for the <br />emergency are as follows: <br /> <br />a. The operation of taxicabs within the City of Santa <br />Ana is of great importance and of great impact to the <br />public health and safety. The City Council further <br />finds that standards and procedures for the issuance <br />of the Certificates of Public Convenience and <br />Necessity to operate taxicabs in the city are necess- <br />ary to protect public health and safety. Such regu- <br />lation of taxicabs is necessary to protect the citi- <br />zens of Santa Ana from inju~'~y such vehicles and <br />to safeguard the public against the use of taxi ve- <br />hicles in illegal acts and for illegal purposes <br />including prostitution. <br /> <br />b. The City of Santa Aha has had severe problems <br />in enforcing fair competition practices and taxi <br />operations among the taxi companies operating in <br />the City under the present ordinance. The City <br />has acted to alleviate that problem by drafting <br />an ordinance which has the input and scrutiny of <br />the authorized taxi companies, This ordinance <br />provides standards for fair competition and allows <br />for effective and efficient enforcement of the taxi <br />operations. The standards and procedures of this <br />new ordinance will be substantially superior to <br />those of the existing ordinance in protecting the <br />health and safety of the citizens of the City of <br />Santa Aha. <br /> <br />c. There are currently before the city Council <br />several parties seeking Certificates of Public <br />Convenience and Necessity to operate taxicabs. <br />In order to insure the public health and safety <br />in passing upon the requests of these parties, <br />it is necessary that the standards and procedures <br />of the new ordinance be applied without delay. <br /> <br />Section 3: Chapter 38 of the Santa Ana Municipal code, Ve- <br />hicles for Hire, together with all amendments thereto, con- <br />sisting of Sections 38-1 to Section 38-20 inclusive, is <br />hereby repealed. <br /> <br />Section 4: That the Santa Aha Municipal code is hereby <br />amended by adding a chapter, to be numbered Chapter 38, <br />which said chapter reads as follows: <br /> <br />-1- <br /> <br /> <br />
