ORDINANCE NS-1203 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA AMENDING SECTION 2-318 OF THE SANTA <br />ANA MUNICIPAL CODE PERTAINING TO DISQUALIFICA- <br />TION OF PUBLIC OFFICIALS IN CONFLICT OF INTEREST <br />SITUATIONS <br /> <br /> THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN <br />AS FOLLOWS: <br /> <br /> SECTION 1: Section 2-318 of the Santa Ana Municipal Code <br />is hereby amended to read as follows: <br /> <br />Sec. 2-318. Same - Disqualification <br /> <br /> An official who refrains from acting in accordance with <br />Section 3625(b) of the Government Code of the State of calif- <br />ornia shall declare the fact and nature of the interest which <br />disqualifies him in the manner provided in this section. <br /> <br />(a) City Council members shall follow the procedure <br /> set out in Section 2-105 of this Code. <br /> <br />(b) <br /> <br />A member of an appointive board or commission <br />shall openly state to the presiding officer at <br />a public meeting of said bo~y the fact and nature <br />of the interest which disqualifies him and shall <br />not be subject to further inquiry. The disquali- <br />fied men~ber shall be excused by the presiding of- <br />ficer and shall absent himself from the meeting <br />room during debate and vote on the matter. <br /> <br />(c) <br /> <br />Ail other officials named in Section 2-311 who <br />disqualify themselves from acting pursuant to <br />Section 3625(b) of the Government Code of the <br />State of California shall record the fact and <br />nature of their disqualification in a signed <br />memorandum, to be filed as herein provided. <br />A copy shall be provided to the city manager, and, <br />if an appropriate file pertaining to the matter on <br />which action is to be taken exists, an additional <br />copy shall be filed in it. When the disqualified <br />official is the city manager, city attorney or <br />clerk of the council, a copy of the memorandum <br />shall be sent to each member of the City Council, <br />and an additional copy shall be furnished the <br />Clerk of the Council for filing. <br /> <br />The city manager shall promulgate such additional <br />regulations as may be required to implement the <br />provisions of this sub-seotion. <br /> <br /> <br />
