ORDINANCE NO. NS-1211 <br />PAGE FOUR <br /> <br />e <br /> <br />After one year has elapsed from the date of <br />issuance of the permit. <br /> <br />If any inspections have been performed by the <br />Department of Building Safety and Housing. <br /> <br /> If a permit has been issued for a project located in an <br />area outside of the jurisdiction of the City, one hundred <br />per cent (100%) of the mechanical permit fee may be refunded. <br />If a duplicate permit has been erroneously issued, one hundred <br />per cent (100%) of the duplicated permit fee and plan checking <br />fee may be refunded. In no other case shall any part of any <br />plan checking fee be refunded. <br /> <br />Sec. 8-610. Location of Cooling Equipment (Section 1202) <br /> <br /> Section 1202 of the Uniform Mechanical Code is amended by <br />adding a paragraph to the end thereof to read as follows: <br /> <br />When installed outside of a building, no cooling equipment <br />shall be closer than five (5) feet from a side property <br />line. <br /> <br />Sec. 8-620. Location of Evaporative Cooling Systems <br /> (Section 1302) <br /> <br /> Section 1302 of the Uniform Mechanical Code is amended by <br />adding a paragraph to the end thereof to read as follows: <br /> <br />When installed outside of a building no evaporative cool- <br />ing system shall be closer than five (5) feet from a side <br />property line. <br /> <br />Sec~ 8-630. Location of Absorption Refrigerating Equip- <br /> ment (Section 1404) <br /> <br /> Section 1404 of the Uniform Mechanical Code is amended <br />by adding a paragraph to the end thereof to read as follows: <br /> <br />When installed outside of a building, no mechanical <br />absorption equipment shall be closer than five (5) feet <br />from a side property line. <br /> <br /> SECTION 2: If any section, subsection, sentence, <br />clause, phrase or portion of this ordinance is for any <br />reason held to be invalid or unconstitutional by the deci- <br />sion of any court of competent jurisdiction, such decision <br />shall not affect the validity of the remaining portions of <br />this ordinance. The City Council of the City of Santa Ana <br />hereby declares that it would have adopted this ordinance <br />and each section, subsection, sentence, clause, phrase or <br />portion thereof irrespective of the fact that any one or <br />more sections, subsections, clauses, phrases or portions be <br />declared invalid or unconstitutional. <br /> <br /> SECTION 3: Neither the adoption of this ordinance nor <br />the repeal hereby of any ordinance shall in any manner affect <br />the prosecution for violation of ordinances, which violations <br />were committed prior to the effective date hereof, nor be <br />construed as affecting any of the provisions of such ordi- <br />nances relating to the collection of any such license or <br />penalty or the penal provisions applicable to any violation <br />thereof, nor to affect the validity of any bond or case de- <br />posit in lieu thereof,'required to be posted, filed or depo- <br />sited pursuant to any ordinance, and all rights and obliga- <br />tions thereunder appertaining shall continue in full force <br />and effect. <br /> <br /> <br />
