ORDINANCE NO. NS-1221 PAGE TWO WHEREAS, the prior moratorium on the issuance of building permits for the construction of off-premise signs as specified in Ordinance NS-1204 will expire on July 3, 1974. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1: That the Department of Building Safety of the City of Santa Ana shall not issue any permits for the construction of any sign or billboard designed to advertise a product, event, person, or subject not related to the lot upon which such sign is located for a period to terminate upon the effective date of the amending ordinance requiring that such construction be allowed only with the approval of a conditional use permit or for a period of ninety (90) days from the initial effective date of this ordinance, whichever occurs first. SECTION 2: The enactment of this ordinance is hereby found by the City Council to be justified by the public necessity, convenience and general welfare. SECTION 3: If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Santa Ana hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsections, clauses, phrases or portions be declared invalid or unconstitutional. SECTION 4: The Clerk of the Council shall certify to the passage of this ordinance and cause the same to be published in some daily newspaper printed and published in the City of Santa Ana.
