ORDINANCE NO. NS-1223 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE <br />CITY OF SANTA ANA ADDING SECTION 10-40 <br />TO THE SANTA ANA MUNICIPAL CODE PERTAINING <br />TO THE MAKING OF FALSE STATEMENTS OR <br />REPORTS TO CITY OFFICIALS REGARDING CITY <br />OFFICERS OR EMPLOYEES <br /> <br /> THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN <br />AS FOLLOWS: <br /> <br /> SECTION 1: That the Santa Ana Municipal Code is hereby <br />amended by adding a section to be numbered 10-40 which said <br />section reads as follows: <br /> <br />Sec. 10-40. Filing False Statements Regarding City <br /> Officers of Employees Prohibited <br /> <br /> Every person who, having been advised of the provisions <br />of this section, signs a w~ten statement declaring the con- <br />tents thereof to be true, and causes the same to be filed with <br />any department of the City of Santa Ana, for the purpose of <br />causing an ~nvestigation to be made into the activities or <br />conduct of any City officer or employee, knowing such state- <br />ment to be false or without a reasonable belief in the truth <br />thereof when such statement is in fact false, is guilty of <br />a misdemeanor. <br /> <br /> SECTION 2: It is the intent of the City Council of <br />the City of Santa Ana that this ordinance not be construed as <br />to apply to those situations regulated by Penal Code ~148.5 <br />and 148.3 <br /> <br /> SECTION 3: If any section, subsection, sentence, <br />clause, phrase or portion of this ordinance is for any <br />reason held to be invalid or unconstitutional by the deci- <br />sion of any court of competent jurisdiction, such decision <br />shall not affect the validity of the remaining portions of <br />this ordinance. The City Council of the City of Santa Ana <br />hereby declares that it would have adopted this ordinance <br />and each section, subsection, sentence, clause, phrase or <br />portion thereof irrespective of the fact that any one or <br />more sections, subsections, clauses, phrases or portions be <br />declared invalid or unconstitutional. <br /> <br /> SECTION 4: Neither the adoption of this ordinance nor <br />the repeal hereby of any ordinance shall in any manner affect <br />the prosecution for violation of ordinances, which violations <br />were committed prior to the effective date hereof, nor be <br />construed as affecting any of the provisions of such ordi- <br />nances relating to the collection of any such license or <br />penalty or the penal provisions applicable to any violation <br />thereof, nor to affect the validity of any bond or case de- <br />posit in lieu thereof, required to be posted, filed or depo- <br />sited pursuant to any ordinance, and all rights and obliga- <br />tions thereunder appertaining shall continue in full force <br />and effect. <br /> <br /> SECTION 5: The Clerk of the Council shall certify to the <br />passage of this ordinance and cause the same to be published <br />in some daily newspaper printed and published in the City of <br />Santa Ana. <br /> <br /> <br />
