ORDINANCE NO. NS-1237 <br />PAGE NINE <br /> <br /> The finance director or his designated agent shall maintain <br />a record by vehicle permit number showing the type, make,'passen- <br />get capacity, engine number,, state license number, registered <br />owner, lega) owner, and such other information pertinent to the <br />vehicle bearing the vehicle permit. He shall likewise maintain <br />a listing of each such permit issued classified by the name of <br />the holder of the certificate of convenien'ce and necessity autho- <br />rizing the vehicl~ for hire and by the year in which the license <br />fee is paid. A copy of such listing, or ~ortion thereof, certi- <br />fied as correct by the director of finance, shall be made avail- <br />able upon request to the city council or to any hear.ing officer <br />or interested party at any hearing upon the granting, suspension, <br />or revocation of any certificate of convenience and nec. essity. <br /> <br /> SECTION 9: Section 38-20a of the Santa A~a Municipal Code <br />.is amended to read as follows: <br /> <br />Sec. 38-20 a. Affixing of vehicle permit and device <br /> 'evidencing certificate... <br /> <br /> The finance director or his designated agent shall, at the <br /> time he affixes a vehicle permit to the vehicle for hire, also <br /> affix a device in the lower right hand corner of the rear window <br /> which will indicate that this is a vehicle for which a certifi- <br /> cate of convenience and necessity has been granted, provided, <br /> however, that he shall not affix such permit or .such device to <br />-.apy vehicle whichdoes not have an unexpired sticker affixed tO' <br /> it by the Santa Ana Police Department or the California Highway <br /> Patrol evidencing that the vehicle has passed a safety.inspection <br /> <br /> SECTION ilO: Section 38-38 of the San~a Aha Municipal Code <br />is hereby amended to read as follows: <br /> <br />Sec, 38-38. Evidence of Mechanical Condition. <br /> <br />(a) Following the issuance of a certificate of convenience <br />and necessity, the holder shall cause each vehicle to which <br />the certificate applies and which is in operating condition <br />tO be inspected pursuant to section 38-39 as often as necessary <br />to have an uQexpired safety inspection sticker continuously <br />affixed to the vehicle.. <br /> <br /> {b) The chief of police, whenever he has reason to believe <br /> that a vehicle to which a certificate applies is in an. un- <br /> safe operating condition, whether or not such vehicle has <br /> affixed to it an unexpired safety inspection sticker, may, <br /> by written notice to the holder of the certificate, require <br /> such holder to remove the vehicle from use in the business <br /> of soliciting or picking up passengers for hire until such <br /> time as the vehicle has passed a new safety inspection. <br /> <br /> S~C]~ON ll: Section 38-39 of the Santa Aha Municipal Code <br />i$~he~eby amended to read-aU' follows: <br /> S~ 38-39.
