ORDINANCE NO. NS-1241 <br />PAGE SEVEN <br /> <br />or responsibilities assigned to the director of public works <br />by this ordinance. <br /> <br />Sec. 10-237. Appeals <br /> <br /> Any person or entity aggrieved by a finding, notice, or <br />action taken under the provisions of this ordinance, may appeal <br />pursuant to the procedures of Chapter 3 of this code, and shall <br />be apprised of his right to appeal. <br /> <br />Sec. 10-238. Violation Penalty <br /> <br /> Any person violating any of the provisions of this <br />ordinance shall be guilty of an infraction, and upon conviction <br />thereof, shall be subject to a fine not to exceed fifty dollars <br />($50) for a first violation; a fine not exceeding one hundred <br />dollars ($100) for a second violation of the same ordinance <br />within one year; a fine not exceeding two hundred fifty dollars <br />($250) for each additional violation of the same ordinance <br />within one year. Each day that such violation is committed <br />or permitted to continue shall constitute a separate offense <br />and shall be punishable as such hereunder. <br /> <br /> SECTION 2: If any section, subsection, sentence, clause <br />phrase or portion of this ordinance is for any reason held to be <br />invalid or unconstitutional by the decision of any court of <br />competent jurisdiction, such decision shall not affect the valid- <br />ity of the remaining portions of this ordinance. The City Council <br />of the City of Santa Ana hereby declares that it would have adopted <br />this ordinance and each section, subsection, sentence, clause, <br />phrase or portion thereof irrespective of the fact that any one or <br />more sections, subsections, clauses, phrases or portions be declared <br />invalid or unconstitutional. <br /> <br /> SECTION 3: Neither the adoption of this ordinance nor <br />the repeal hereby of any ordinance shall in any manner affect <br />the prosecution for violation of ordinances, which violations <br />were committed prior to the effective date hereof, nor be <br />construed as affecting any of the provisions of such ordinance <br />relating to the collection of any such license or penalty or <br />the penal provisions applicable to any violation thereof, nor <br />to affect the validity of any bond or case deposit in lieu thereof, <br />required to be posted, filed or deposited pursuant to any ordinance <br />and all rights and obligations thereunder appertaining shall <br />continue in full force and effect. <br /> <br /> SECTION 4: The Clerk of the Council shall certify to <br />passage of this ordinance and cause the same to be published <br />in some daily newspaper printed and published in the City of <br />Santa Ana. <br /> <br />the <br /> <br /> SECTION 5: This ordinance shall take effect upon post±n§ <br />or publication whichever comes first. <br /> <br /> PASSED AND ADOPTED by the City Council of the City of <br />Santa Ana at its regular meeting held on the <br /> <br /> <br />
