be <br /> <br /> K. Variances From Lar~t Use Control <br /> <br /> 1. Review of Applications for Issuance of Variances <br /> <br /> No variance from the established City ordinances shall be issued for any <br /> <br />property in the Project Area from the date of adoption of this Plan, until the <br />application for such variance has been processed in the manner herein provided. <br />Any such variance that is issued rmst be in conformance with the provisions of <br />this Plan. <br /> <br /> Upon receipt of such an application for variance the Executive Director of A~ency shall <br />requested by the City Planning Department to review the application to determine <br /> <br />what effect, if any, the issuance thereof would have upon the Plan. Thereafter B~ecutive <br />Director after conferring with the Planning Department Shall file with the <br /> <br />Planning Co~muission a ~Tittan report setting forth findings of fact, but not <br /> <br />limited to, the following: <br /> <br /> 1. Whether the proposed variance would be compatible with <br /> <br /> the standards and other requirements set forth ~.~ the Plan; and <br /> <br /> 2. What modifications, if any, in the proposed variance would be <br /> <br /> necessary in order to meet the requirements of the Plan; and <br /> <br /> 3. Whether the applicant has entered into an agreement with the <br /> Agency for the development of improvements in accordance with the <br /> variance and subnLitted plans to the Agency. <br /> <br /> After receipt of said report, the Planning CA~ission may allow the issuance <br /> <br />of the variance with conditions; or may withhold the issuance of the variance if <br />the Executive Director finds that the proposed im?rovement does not meet the <br />requirements of the Plan. Within five (5) days after allowing or withholding <br />issuance of the variance the Planning Department shall notify by certified mail <br /> <br />the applicant of its decision. <br /> <br />-32- <br /> <br /> <br />
