NS- 1273 <br /> <br />AN ORDINANCE OF THE CITY OF SANTA ANA AMENDING THE <br />SANTA ANA MUNICIPAL CODE BY AMENDING SECTION <br />14-23 BY PROVIDING THE AUTHORITY TO ESTABLISH AND <br />COLLECT FEES FOR MEDICAL CARE AND EMERGENCY SER- <br />VICES RENDERED BY PARAMEDICS USING PARAMEDIC VEHI- <br />CLES OWNED BY THE CITY OF SANTA ANA OR OTHER CITY <br />OF SANTA ANA FIRE DEPARTMENT VEHICLES WHERE THE <br />PERSON IS NOT TRANSPORTED BY A CITY OWNED PARAMEDIC <br />OR OTHER FIRE DEPARTMENT VEHICLE <br /> <br /> THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES <br />ORDAIN AS FOLLOWS: <br /> <br /> SECTION 1: That the Santa Aha Municipal Code is hereby <br />amended by amending Section 14-23, to read as follows: <br /> <br />Sec. 14-23. Fees for Paramedic Services. <br /> <br /> The City may establish and collect fees, for emergency <br />transportation of persons in paramedic or other Fire Department <br />vehicles owned by the City of Santa Aha to a hospital for <br />medical care and for emergency services rendered to persons <br />by paramedics, and for emergency services and medical care <br />rendered to persons by paramedics using City of Santa Aha <br />owned paramedic vehicles or other City of Santa Ana Fire <br />Department vehicles where the person is not transported by <br />a City owned paramedic or other Fire Department vehicle. <br />The City Council may establish such fees by resolution. <br /> <br /> The Fire Chief shall notify the Director of Finance <br />following such emergency transportation, medical care, or <br />emergency services, in writing of the name and address of <br />the person, date and time of the transportation, medical care, <br />or emergency services performed, and such other information <br />as may be required. The Director of Finance shall thereafter <br />cause appropriate billings to be made. <br /> <br /> Such fees for transportation, medical care <br />gency services shall not be less than the average <br />by commercial ambulances for comparable services <br /> <br />and emer- <br />fees charged <br />in the City. <br /> <br /> The amount of such fees charged shall be deemed a debt <br />to the City of the person or persons receiving said services <br />and, if minors, their parents or guardians. Any person owing <br />money shall be liable in an action brought in the name of <br />the City for recovery of such amount, including reasonable <br />attorney's fees. <br /> <br /> SECTION 2: If any section, subsection, sentence, clause, <br />phrase or portion of this ordinance is for any reason held <br />to be invalid or unconstitutional by the decision of any court <br />of competent jurisdiction, such decision shall not affect <br />the validity of the remaining portions of this ordinance. <br />The City Council of the City of Santa Ana hereby declares <br />that it would have adopted this ordinance and each section, <br />subsection, sentence, clause, phrase or portion thereof irrespec- <br />tive of the fact that any one or more sections, subsections, <br />clauses, phrases or portions be declared invalid or unconstitu- <br />tional. <br /> <br /> <br />
