REL :nr <br /> <br />ORDINANCE NO. NS- 1285 <br /> <br />AN ORDINANCE OF THE CITY OF SANTA ANA APPROVING <br />AMENDMENT APPLICATION NO. 732 FILED BY E. G. <br />WARMINGTON, REZONING PROPERTY FROM THE Rlt R4 <br />AND LP DISTRICTS TO THE R1-PRD AND R4-PRD <br />(PLANNED RESIDENTIAL DEVELOPMENT) DISTRICTS, <br />AND AMENDING SECTIONAL DISTRICT MAP 8-5-9. <br /> <br /> WHEREAS, the Planning Commission has given notice of <br />and duly held a public hearing on Amendment Application No. 732, <br />filed by E. G. Warmington to rezone property generally located <br />on the east Cabrillo Park Drive, between Wellington Avenue on <br />the north and Fruit Street on the south, from the R1, R4 and LP <br />Districts to the R4-PRD District; and <br /> <br /> WHEREAS, the Planning Commission by its Resolution No. <br />6077 has recommended approval of said application subject to the <br />modification that that portion of the said property presently <br />zoned in the R1 District be rezoned to the R1-PRD District; and <br /> <br /> WHEREAS, the City Council regularly held a public hear- <br />ing on said reclassification on published notice required by law, <br />and does now find that the public necessity, convenience and <br />general welfare require that the said property be reclassified <br />from the R1, R4 and LP Districts to the R1-PRD and R4-PRD Dis- <br />tricts, and that the new classification will not be detrimental <br />to the surrounding property; <br /> <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA <br />ANA DOES ORDAIN AS FOLLOWS: <br /> <br /> SECTION 1: That the real property in the City of Santa <br />Ana, County of Orange, California, described as Parcel 4 of <br />Parcel Map 918 and Parcel 1 of Parcel Map 919, as shown on maps <br />recorded in Parcel Map Book 72, pages 13 and 15, in the Office <br />of the County Recorder, County of Orange, California, is hereby <br />reclassified from the R1 District to the R1-PRD District and <br />from the R4 and LP Districts to the R4-PRD District, and that <br />Sectional District Map 8-5-9 is hereby amended to show said re- <br />classification, in accordance with Exhibit A.A. 732-B. <br /> <br /> SECTION 2: If any section, subsection, sentence, clause, <br />phrase or portion of this ordinance is for any reason held to be <br />invalid or unconstitutional by the decision of any court of com- <br />petent jurisdiction, such decision shall not affect the validity <br />of the remaining portions of this ordinance. The City Council <br />of the City of Santa Ana hereby declares that it would have adopted <br />this ordinance and each section, subsection, sentence, clause, <br />phrase or portion thereof irrespective of the fact that any one <br />or more sections, subsections, sentences, clauses, phrases or por- <br />tions be declared invalid or unconstitutional. <br /> <br /> SECTION 3: Neither the adoption of this ordinance nor <br />the repeal hereby of any ordinance shall in any manner affect the <br />prosecution for violation of ordinances, which violations were <br />committed prior to the effective date hereof, nor be construed <br />as affecting any of the provisions of such ordinance relating to <br />the collection of any such license or penalty or the penal provi- <br />sions applicable to any violation thereof, nor to affect the vali- <br />dity of any bond or cash deposit in lieu thereof, required to be <br />posted, filed or deposited pursuant to any ordinance and all rights <br />and obligations thereunder appertaining shall continue in full <br />force and effect. <br /> <br /> <br />
