RCS:rs <br />2-11-76 <br /> <br />ORDINANCE NO. NS- 1299 <br /> <br />AN ORDINANCE OF THE CITY OF SANTA ANA APPROVING <br />AMENDMENT APPLICATION NO. 736 INITIATED BY THE <br />PLANNING COMMISSION TO REZONE REAL PROPERTY FROM <br />P (PROFESSIONAL), HEIGHT DISTRICT II AND 0 (OPEN <br />SPACE) DISTRICT TO THE SD (SPECIFIC DEVELOPMENT) <br />DISTRICT, AND AMENDING SECTIONAL DISTRICT MAP 12-5-10. <br /> <br /> .W~HEREAS, the Planning Commission has initiated Amendment <br />Application No. 736 to rezone real property generally located south <br />of the line of former Second Street, West of Birch Street, north of <br />First Street, and east of Ross Street, all in the City of Santa Ana, <br />which property comprises the Senior Citizens Housing Project; and <br /> <br /> WHEREAS, the Planning Commission has given notice of and <br />duly held a public hearing on Amendment Application No. 736 to re- <br />zone such parcels from the P (Professional), Height District II <br />and O (Open Space) District to the SD (Specific Development) District <br />and has recommended approval of said Application; and <br /> <br /> WHEREAS, the City Council regularly held a public hearing <br />on said reclassification andpublished notice as required by law <br />and does now find that the public necessity, convenience, and <br />general welfare require that said property be reclassified from <br />the P (Professional),.Height District II and 0 (Open Space) District <br />to the SD (Specific Development) District and that the new classifi- <br />cation will not be detrimental to the surrounding property; <br /> <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA ANA <br />DOES ORDAIN AS FOLLOWS: <br /> <br /> SECTION 1: That the real property situated in the City <br />of Santa Ana, County of Orange, State of California, bounded by <br />First Street, Ross Street, Birch Street and the north line of <br />what was formerly Second Street, more particularly described in <br />Exhibit "A", attached hereto and incorporated by reference herein, <br />is hereby reclassified from the P (Professional), Height District <br />II and 0 (Open Space) District, as the case may be, to the SD <br />(Specific Development) District, and that Sectional District Map <br />12-5-10 is hereby amended to show said reclassification in accord- <br />ance with Amendment Application No. 736 and Exhibits attached <br />thereto, a copy of which is on file with the Clerk of the Council. <br /> <br /> SECTION 2: If any section, subsection, sentence, clause, <br />phrase or portion of this ordinance is for any reason held to be <br />invalid or unconstitutional by the decision of any court of com- <br />petent jurisdiction, such decision shall not affect the validity <br />of the remaining portions of this ordinance. The City Council of <br />the City of Santa Ana hereby declares that it would have adopted <br />this ordinance and each section, subsection, sentence, clause, <br />phrase or portion thereof irrespective of the fact that any one <br />or more sections, subsections, sentences, clauses, phrases, or <br />portions be declared invalid or unconstitutional. <br /> <br /> SECTION 3: Neither the adoption of this ordinance nor <br />the repeal hereby of any ordinance shall in any manner affect the <br />prosecution for violation of ordinances, which violations were <br />committed prior to the effective date hereof, nor be construed as <br />affecting any of the provisions of such ordinance relating to the <br /> <br /> <br />
