NS-1307 <br /> <br />AN ORDINANCE OF THE CITY OF SANTA ANA <br />ADDING SECTION 9-5.1 TO THE SANTA ANA <br />MUNICIPAL CODE, RELATING TO INELIGIBI- <br />LITY FOR EMPLOYMENT FOR CRIMINAL CON- <br />DUCT <br /> <br /> THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN <br />AS FOLLOWS: <br /> <br /> SECTION 1: The Santa Ana Municipal Code is hereby <br />amended by adding a section, to be numbered 9,5.1, which said <br />section reads as follows: <br /> <br />Section 9-5.1. Criminal Conduct - Ineligibility for Employment. <br /> <br /> Except as otherwise hereinafter provided, no person convicted <br />of a felony or misdemeanor involving moral turpitude shall be <br />eligible for employment in the excepted or competitive service <br />of the City; provided, however, that the appointing authority <br />may disregard such conviction if he finds and determines that <br />mitigating circumstances exist, such as, but not limited to, <br />evidence of rehabilitation, length of time elapsed since such <br />conviction, the age of such person at the time of conviction, <br />or the fact that the position applied for or occupied by such <br />person is unrelated to such conviction. <br /> <br /> The City Manager, Assistant City Manger, Deputy City Manager <br />for Administrative and Support Services, Personnel Director, <br />Chief of Police, City Attorney, and each appointing authority <br />of the City, are hereby authorized to have access to the "State <br />Summary Criminal History Information" as provided for in Section <br />11105 of the Penal Code of the State of California. <br /> <br /> SECTION 2: If any section, subsection, sentence, clause, <br />phrase or portion of this ordinance is for any reason held to <br />be invalid or unconstitutional by the decision of any court of <br />competent jurisdiction, such decision shall not affect the valid- <br />ity of the remaining portions of this ordinance. The City Council <br />of the City of Santa Ana hereby declares that it would have adop- <br />ted this ordinance and each section, subsection, sentence, clause, <br />phrase or portion thereof irrespective of the fact that any one <br />or more sections, subsection, sentences, clauses, phrases or <br />portions be declared invalid or unconstitutional. <br /> <br /> PASSED AND ADOPTED by the City Council of the City of <br />Santa Ana at its regular meeting held on the 2nd <br />day of August , 1976. <br />ATTEST: ~~ <br /> <br />MAYOR <br /> <br />CLERK OF THE COUNCIL <br /> <br /> <br />
