NS-1315 <br /> <br />AN ORDINANCE OF THE CITY OF SANTA ANA <br />APPROVING AMENDMENT APPLICATION NO. 742 <br />INITIATED BY THE PLANNING COMMISSION <br />REZONING PROPERTY FROM THE Cl (COMMUNITY <br />COMMERCIAL) DISTRICT TO THE C4 (PLANNED <br />SHOPPING CENTER) DISTRICT, AND AMENDING <br />SECTIONAL DISTRICT MAP 27-5-10 <br /> <br /> WHEREAS, the Planning Commission has initiated Amend- <br />ment Application No. 742 to rezone property generally located <br />on the south side of Warner Avenue between Greenville Street <br />and Fairview Road from the Cl (Community Commercial) District <br />to the C4 (Planned Shopping Center) District, and said Commission <br />has recommended approval of said application after notice and <br />hearing thereon; and <br /> <br /> WHEREAS, the City Council regularly held a public <br />hearing on said reclassification on published notice required <br />by law, and does now find that the public necessity, convenience, <br />and general welfare require that the said property be reclassified <br />from the C1 (Community Commercial) District to the C4 (Planned <br />Shopping Center) District, and that such new classification <br />will not be detrimental to the surrounding property; <br /> <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA <br />ANA DOES ORDAIN AS FOLLOWS: <br /> <br /> SECTION 1: That the real property in the City of <br />Santa Ana, County of Orange, California, described as Parcels <br />1, 2, and 3 as shown on a map recorded in Book 35, page 46 <br />of Parcel Maps, Official Records of Orange County, California, <br />is hereby reclassified from the C1 (Community Commercial) District <br />to the C4 (Planned Shopping Center) District, and that Sectional <br />District Map 27-5-10 is hereby amended to show said reclassifi- <br />cation, in accordance with Exhibit A.A. 742-A. <br /> <br /> SECTION 2: Neither the adoption of this ordinance nor <br />the repeal hereby of any ordinance shall in any manner affect <br />the prosecution for violation of ordinances, which violations <br />were committed prior to the effective date hereof, nor be con- <br />strued as affecting any of the provisions of such ordinance <br />relating to the collection of any such license or penalty or <br />the penal provisions applicable to any violation thereof, nor <br />to affect the validity of any bond or cash deposit in lieu <br />thereof, required to be posted, filed or deposited pursuant to <br />any ordinance and all rights and obligations thereunder apper- <br />taining shall continue in full force and effect. <br /> <br /> ADOPTED, this l§th <br />following vote: <br /> <br />day of A~, 1976, by the <br /> <br />AYES: COUNCILMEN: Ward, Brandt, Bricken, Yamamoto, Evans <br /> <br />NOES: COUNCILMEN: None <br /> <br />ATTEST: <br /> <br />ABSENT: <br /> <br />COUNCILMEN: Ortiz, Garthe <br /> <br /> MAYOR <br /> <br />CLERK OF THE COUNCIL <br /> <br /> <br />
