NS-1520 <br /> <br />AN ORDINANCE OF THE CITY OF SANTA ANA <br />APPROVING AMENDMENT APPLICATION NO. 744 <br />FILED BY ELIAS JOHN GARCIA REZONING PRO- <br />PERTY FROM THE C4 (PLANNED SHOPPING CENTER) <br />DISTRICT TO THE R 1 (SINGLE-FAMILY RESIDENCE) <br />DISTRICT AND AFIENDING SECTIONAL DISTRICT MAP <br />16-5-10 <br /> <br /> WHEREAS, the Planning Commission has given notice of <br />and duly held a public hearing on Amendment Application No. 744, <br />filed by Elias John Garcia to rezone property, generally located <br />on the north side of McFadden Avenue between Harbor Blvd. and <br />Newhope Street from the C4 (Planned Shopping Center) District <br />to the R1 (Single-Family Residence) District, and said Commission <br />has recommended approval of said application; and <br /> <br /> WHEREAS, the City Council regularly held a public hear- <br />ing on said reclassification on published notice required by law, <br />and does now find that the public necessity, convenience, and <br />general welfare require that the said property be reclassified <br />from the C4 (Planned Shopping Center) District to the R1 (Single- <br />Family Residence) District, and that such new classification will <br />not be detrimental to the surrounding property; <br /> <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA <br />ANA DOES ORDAIN AS FOLLOWS: <br /> <br /> SECTION 1: That the real property in the City of Santa <br />Ana, County of Orange, California, described as Parcel 1, as shown <br />on a map filed in Book 60, Page 26, of Parcel Maps, Records of <br />Orange County, California, is hereby reclassified from the C4 <br />(Planned Shopping Center) District to the R1 (Single-Family Resi- <br />dence) District, and that Sectional District Map 16-5-10 is hereby <br />amended to show said reclassification, in accordance with Exhibit <br />A.A. 744-A. <br /> <br /> SECTION 2: Neither the adoption of this ordinance nor the <br />repeal hereby of any ordinance shall in any manner affect the prose- <br />cution for violation of ordinances, which violations were committed <br />prior to the effective date hereof, nor be construed as affecting <br />any of the provisions of such ordinance relating to the collection <br />of any such license or penalty or the penal provisions applicable <br />to any violation thereof, nor to affect the validity of any bond or <br />cash deposit in lieu thereof, required to be posted, filed or depo- <br />sited pursuant to any ordinance and all rights and obligations there- <br />under appertaining shall continue in full force and effect. <br /> <br /> ADOPTED, this 20th day of September , 1976, by <br />the following vote: <br /> <br /> AYES: COUNCILMEN: Ward, Brandt~ 0rtiz, Garthe <br /> NOES: COUNCILMEN: None <br /> <br /> ABSENT: COUNCILMEN: Evans <br /> ABSTAINED: COUNCILMEN: Bricken, Yamamoto <br />ATTEST: ~ <br /> ~LORENCEI.
