REL: nr <br />9-1-76 <br /> <br />ORDINANCE NO. NS-1322 <br /> <br />AN ORDINANCE OF THE CITY OF SANTA ANA APPROVING <br />AMENDMENT APPLICATION NO. 743 FILED BY THE SANTA <br />ANA UNIFIED SCHOOL DISTRICT REZONING PROPERTY <br />FROM THE 0 (OPEN SPACE) DISTRICT TO THE R1 (SINGLE- <br />FAMILY RESIDENCE) DISTRICT, AND AMENDING SECTIONAL <br />DISTRICT MAP 26-5-10 <br /> <br /> WHEREAS, the Planning Commission has given notice of <br />and duly held a public hearing on Amendment Application No. 743, <br />filed by the Santa Ana Unified School District to rezone property, <br />generally located on the northeast corner of Raitt Street and <br />Segerstrom Avenue from the O (Open Space) District to the R1 <br />(Single-Family Residence) District, and said Commission has recom- <br />mended approval of said application; and <br /> <br /> WHEREAS, the City Council regularly held a public hear- <br />ing on said reclassification on published notice required by law, <br />and does now find that the public necessity, convenience, and <br />general welfare require that the said property be reclassified from <br />the 0 (Open Space) District to the R1 (Single-Family Residence) <br />District, and that such new classification will not be detrimental <br />to the surrounding property; <br /> <br /> NOW~ THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA <br />ANA DOES ORDAIN AS FOLLOWS: <br /> <br /> SECTION 1: That the real property in the City of Santa <br />Ana, County of Orange, California, described as follows: <br /> <br />That portion of Lot 8 of the Williams Tract, in the <br />City of Santa Ana, County of Orange, State of California, <br />as per map recorded in Book 30, Page 14 of Deeds, in the <br />office of the county recorder of Los Angeles County, <br />California, described as follows: beginning at the <br />Southeast corner of said lot; thence South 88° 53' 40" <br />West 1421.13 feet to the true point of beginning; thence <br />North 01O 03' 20" West 772.20 feet to the North line of <br />said lot; thence South 88° 53' 40" West along said North <br />line to a line which bears North 1° 00' 20" West from a <br />point on the survey center line of Talbert Avenue, <br />North 88° 44' 40" East 2009.98 feet from the center line <br />intersection of Talbert Avenue and Old Fairview Road; <br />thence South 1° 00' 20" East 771.60 feet to the South <br />line of said lot; thence North 88053' 40" East to the <br />true point of beginning, <br /> <br />is hereby reclassified from the 0 (Open Space) District to the Ri <br />(Single-Family Residence) District and that Sectional District Map <br />26-5-10 is hereby amended to show said reclassification, in accor- <br />dance with Exhibit A.A. 743-A. <br /> <br /> SECTION 2: Neither the adoption of this ordinance nor <br />the repeal hereby of any ordinance shall in any manner affect the <br />prosecution for violation of ordinances, which violations were com- <br />mitted prior to the effective date hereof, nor be construed as <br />affecting any of the provisions of such ordinance relating to the <br />collection of any such license or penalty or the penal proviwions <br />applicable to any violation thereof, nor to affect the validity of <br />any bond or cash deposit in lieu thereof, required to be posted, <br />filed or deposited pursuant to any ordinance and all rights and <br />obligations thereunder appertaining shall continue in full force <br />and effect. <br /> <br /> <br />
