REL: nr 9-1-76 ORDINANCE NO. NS-13Z3 AN ORDINANCE OF THE CITY OF SANTA ANA APPROVING AMENDMENT APPLICATION NO. 746 INITIATED BY THE PLANNING COMMISSION REZONING PROPERTY FROM THE O (OPEN SPACE) DISTRICT TO THE R1 (SINGLE-FAMILY RESIDENCE) DISTRICT, AND AMENDING SECTIONAL DIS- TRICT MAP 26-5-10 WHEREAS, the Planning Commission has initiated Amendment Application No. 746 to rezone property generally located on the north side of Segerstrom Avenue approximately 550 feet east of Raitt Street from the 0 (Open Space) District to the R1 (Single- Family Residence) District, and said Commission has recommended approval of said application after notice and hearing thereon; and WHEREAS, the City Council regularly held a public hearing on said reclassification on published notice required by law, and does now find that the public necessity, convenience, and general welfare require that the said property be reclassified from the O (Open Space) District to the R1 (Single-Family Residence) Dis- trict, and that such new classification will not be detrimental to the surrounding property; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN AS FOLLOWS: SECTION 1: That the real property in the City of Santa Aha, County of Orange, California, described as follows: Beginning at the centerline intersection of Segerstrom Avenue and Raitt Street, thence N. 01°03'20"W. along the centerline of Raitt Street 772.00 feet, thence leaving said centerline N.88°53'40'' E. 548 feet to the true point of beginning, thence N.88°53'40"E. 85 feet thence S.01°03'20''E. 582 feet, thence N.88°53'40''E. 3 feet, thence S.01°03'20"E. 190 feet more or less to the centerline of Segerstrom Avenue, thence S.88°53'40''W. along said centerline 85 feet, thence N.01°03'20''W. 772 feet to the true point of beginning, is hereby reclassified from the 0 (Open Space) District to the Ri (Single-Family Residence) District, and that Sectional District Map 26-5-10 is hereby amended to show said reclassification, in accordance with Exhibit A.A. 746-A. SECTION 2: Neither the adoption of this ordinance nor the repeal hereby of any ordinance shall in any manner affect the prosecution for violation of ordinances, which violations were com- mitted prior to the effective date hereof, nor be construed as affect- ing any of the provisions of such ordinance relating to the collection of any such license or penalty or the penal provisions applicable to any violation thereof, nor to affect the validity of any bond or cash deposit in lieu thereof, required to be posted, filed or de- posited pursuant to any ordinance and all rights and obligations thereunder appertaining shall continue in full force and effect.
