REL: nr <br />9-1-76 <br /> <br />ORDINANCE NO. NS-13Z3 <br /> <br />AN ORDINANCE OF THE CITY OF SANTA ANA APPROVING <br />AMENDMENT APPLICATION NO. 746 INITIATED BY THE <br />PLANNING COMMISSION REZONING PROPERTY FROM THE <br />O (OPEN SPACE) DISTRICT TO THE R1 (SINGLE-FAMILY <br />RESIDENCE) DISTRICT, AND AMENDING SECTIONAL DIS- <br />TRICT MAP 26-5-10 <br /> <br /> WHEREAS, the Planning Commission has initiated Amendment <br />Application No. 746 to rezone property generally located on the <br />north side of Segerstrom Avenue approximately 550 feet east of <br />Raitt Street from the 0 (Open Space) District to the R1 (Single- <br />Family Residence) District, and said Commission has recommended <br />approval of said application after notice and hearing thereon; and <br /> <br /> WHEREAS, the City Council regularly held a public hearing <br />on said reclassification on published notice required by law, and <br />does now find that the public necessity, convenience, and general <br />welfare require that the said property be reclassified from the <br />O (Open Space) District to the R1 (Single-Family Residence) Dis- <br />trict, and that such new classification will not be detrimental <br />to the surrounding property; <br /> <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA <br />ANA DOES ORDAIN AS FOLLOWS: <br /> <br /> SECTION 1: That the real property in the City of Santa <br />Aha, County of Orange, California, described as follows: <br /> <br />Beginning at the centerline intersection of Segerstrom <br />Avenue and Raitt Street, thence N. 01°03'20"W. along <br />the centerline of Raitt Street 772.00 feet, thence <br />leaving said centerline N.88°53'40'' E. 548 feet to the <br />true point of beginning, thence N.88°53'40"E. 85 feet <br />thence S.01°03'20''E. 582 feet, thence N.88°53'40''E. <br />3 feet, thence S.01°03'20"E. 190 feet more or less to <br />the centerline of Segerstrom Avenue, thence S.88°53'40''W. <br />along said centerline 85 feet, thence N.01°03'20''W. 772 <br />feet to the true point of beginning, <br /> <br />is hereby reclassified from the 0 (Open Space) District to the Ri <br />(Single-Family Residence) District, and that Sectional District <br />Map 26-5-10 is hereby amended to show said reclassification, in <br />accordance with Exhibit A.A. 746-A. <br /> <br /> SECTION 2: Neither the adoption of this ordinance nor <br />the repeal hereby of any ordinance shall in any manner affect the <br />prosecution for violation of ordinances, which violations were com- <br />mitted prior to the effective date hereof, nor be construed as affect- <br />ing any of the provisions of such ordinance relating to the collection <br />of any such license or penalty or the penal provisions applicable <br />to any violation thereof, nor to affect the validity of any bond or <br />cash deposit in lieu thereof, required to be posted, filed or de- <br />posited pursuant to any ordinance and all rights and obligations <br />thereunder appertaining shall continue in full force and effect. <br /> <br /> <br />
