NS- 1327 <br /> <br />AN ORDINANCE OF THE CITY OF SANTA ANA APPROVING <br />AMENDMENT APPLICATION NO. 745 FILED BY TUSFORD- <br />WARMINGTON REZONING PROPERTY FROM THE R4 (SUBURBAN <br />APARTMENT) DISTRICT TO THE R4-PRD (PLANNED RESI- <br />DENTIAL DEVELOPMENT) DISTRICT, AND AMENDING SEC- <br />TIONAL DISTRICT MAP 8-5-9 <br /> <br /> WHEREAS, the Planning Commission has given notice of <br />and duly held a public hearing on Amendment Application No. 745, <br />filed by Tusford-Warmington to rezone property, generally located <br />on the east side of Williams Street between Seventeenth Street <br />and Wellington Avenue from the R4 (Suburban Apartment) District <br />to the R4-PRD (Planned Residential Development) District, and <br />said Commission has recommended approval of said application; <br />and <br /> <br /> WHEREAS, the City Council regularly held a public hear- <br />ing on said reclassification on published notice required by law, <br />and does now find that the public necessity, convenience, and <br />general welfare require that the said property be reclassified <br />from the R4 (Suburban Apartment) District to the R4-PRD (Planned <br />Residential Development) District, and that such new classifica- <br />tion will not be detrimental to the surrounding property; <br /> <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA <br />ANA DOES ORDAIN AS FOLLOWS: <br /> <br /> SECTION l: That the real property in the City of Santa <br />Ana, County of Orange, California, described as being a portion <br />of Lot 4 of subdivisions of the Mabury Tract as per map recorded <br />in Book 36, Page 65, miscellaneous records of Los Angeles County, <br />is hereby reclassified from the R4 (Suburban Apartment) District <br />to the R4-PRD (Planned Residential Development) District, and <br />that Sectional District Map 8-5-9 is hereby amended to show said <br />reclassification, in accordance with Exhibit A.A. 745-A. <br /> <br /> SECTION 2: Neither the adoption of this ordinance nor <br />the repeal hereby of any ordinance shall in any manner affect <br />the prosecution for violation of ordinances, which violations <br />were committed prior to the effective date hereof, nor be con- <br />strued as affecting any of the provisions of such ordinance re- <br />lating to the collection of any such license or penalty or the <br />penal provisions applicable to any violation thereof, nor to <br />affect the validity of any bond or cash deposit in lieu thereof, <br />required to be posted, filed or deposited pursuant to any ordi- <br />nance and all rights and obligations thereunder appertaining <br />shall continue in full force and effect. <br /> <br /> ADOPTED, this 1Sth <br />the following vote: <br /> AYES: COUNCILMEN: <br /> NOES: COUNCILMEN: <br /> <br />day of November , 1976, by <br />Ward, Brandt, Ortiz, Yamamoto, <br />None <br /> <br />Garthe <br /> <br /> ABSENT: COUNCILMEN: None <br /> ABSTAINED: COUNCILMEN: Bricken, Evans <br /> <br />'CLERK OF THE COUNCIL <br /> <br />APPROVED AS TO FORM: <br /> <br />KEITH L.
