REL:nr <br />9-28-76 <br /> <br />ORDINANCE NO. NS- 1328 <br /> <br />AN ORDINANCE OF THE CITY OF SANTA ANA APPROVING <br />AMENDMENT APPLICATION NO. 747 FILED BY WILLIS <br />BOYD, SR. REZONING PROPERTY FROM THE A1 (GENERAL <br />AGRICULTURAL) USE DISTRICT TO THE M1 (LIGHT <br />INDUSTRIAL) USE DISTRICT, AND AMENDING SECTIONAL <br />DISTRICT MAP 17-5-9 <br /> <br /> WHEREAS, the Planning Commission has given notice of <br />and duly held a public hearing on Amendment Application No. 747, <br />filed by Willis Boyd, Sr. to rezone property, generally located <br />on the south side of McFadden Avenue, between Ritchey Street and <br />the Newport Freeway from the A1 (General Agricultural) Use Dis- <br />trict to the M1 (Light Industrial) Use District, and said Commis- <br />sion has recommended approval of said application; and <br /> <br /> WHEREAS, the City Council regularly held a public hear- <br />ing on said reclassification on published notice required by law, <br />and does now find that the public necessity, convenience, and <br />general welfare require that the said property be reclassified <br />from the A1 (General Agricultural) Use District to the M1 (Light <br />Industrial) Use District, and that such new classification will <br />not be detrimental to the surrounding property; <br /> <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA <br />ANA DOES ORDAIN AS FOLLOWS: <br /> <br /> SECTION l: That the real property in the City of Santa <br />Ana, County of Orange, California, described as follows: <br /> <br />Commencing at a point 17.50 chains East from the <br />Northeast corner of the land known as the Tichenal <br />tract, running thence South 5.665 chains to the <br />Northerly line of the Southern California Railroad <br />right of way, thence South 50 degrees East along <br />said Northerly line of said right of way, !5.405 <br />chains to a point; thence North 15.664 chains, <br />thence West 11.937 chains to the point of beginning, <br />containing 18.72 acres, more or less, <br /> <br />is hereby reclassified from the A1 (General Agricultural) Use Dis- <br />trict to the M1 (Light Industrial) Use District and that Sectional <br />District Map 17-5-9 is hereby amended to show said reclassifica- <br />tion, in accordance with Exhibit A.A. 747-A. <br /> <br /> SECTION 2: Neither the adoption of this ordinance nor <br />the repeal hereby of any ordinance shall in any manner affect <br />the prosecution for violation of ordinances, which violations <br />were committed prior to the effective date hereof, nor be con- <br />strued as affecting any of the provisions of such ordinance re- <br />lating to the collection of any such license or penalty or the <br />penal provisions applicable to any violation thereof, nor to <br />affect the validity of any bond or cash deposit in lieu thereof, <br />required to be posted, filed or deposited pursuant to any ordi- <br />nance and all rights and obligations thereunder appertaining <br />shall continue in full force and effect. <br /> <br /> <br />
