REL:nr <br />9-28-76 <br /> <br />ORDINANCE NO. NS-1329 <br /> <br />AN ORDINANCE OF THE CITY OF SANTA ANA APPROVING <br />AMENDMENT APPLICATION NO. 749 FILED BY ARNOLD <br />B. GASSER, PAULA GASSER, AND COMMONWEALTH SER- <br />VICE CORP. REZONING PROPERTY FROM THE C1 (COM- <br />MUNITY COMMERICAL) USE DISTRICT TO THE R1 (SINGLE- <br />FAMILY RESIDENCE) USE DISTRICT, AND AMENDING SEC- <br />TIONAL DISTRICT MAP 22-5-10 <br /> <br /> WHEREAS, the Planning Commission has given notice of and <br />duly held a public hearing on Amendment Application No. 749, filed <br />by Arnold B. Gasser, Paula Gasser, and Commonwealth Service Corp. to <br />rezone property, generally located on the east side of Fairview <br />Street between Borchard and Edinger Avenues from the C1 (Community <br />Commercial) Use District to the (Single-Family Residence) Use Dis- <br />trict, and said Commission has recommended approval of said applica- <br />tion; and <br /> <br /> WHEREAS, the City Council regularly held a public hear- <br />ing on said reclassification on published notice required by law, <br />and does now find that the public necessity, convenience, and <br />general welfare require that the said property be reclassified from <br />the Cl (Community Commercial) Use District to the R1 (Single-Family <br />Residence) Use District, and that such new classification will not <br />be detrimental to the surrounding property; <br /> <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA <br />ANA DOES ORDAIN AS FOLLOWS: <br /> <br /> SECTION l: That the real property in the City of Santa <br />Ana, County of Orange, California, described as all of Parcels 1 and <br />2 of a map recorded in Book 54, Page 32, of Parcel Maps, County of <br />Orange, California, is hereby reclassified from the C1 (Community <br />Commercial) Use District to the R1 (Single-Family Residence) Use Dis- <br />trict, and that Sectional District Map 22-5-10 is hereby amended to <br />show said reclassification, in accordance with Exhibit A.iA. 749-A. <br /> <br /> SECTION 2: Neither the adoption of this ordinance nor <br />the repeal hereby of any ordinance shall in any manner affect <br />the prosecution for violation of ordinances, which violations <br />were committed prior to the effective date hereof, nor be con- <br />strued as affecting any of the provisions of such ordinance re- <br />lating to the collection of any such license or penalty or the <br />penal provisions applicable to any violation thereof, nor to <br />affect the validity of any bond or cash deposit in lieu thereof, <br />required to be posted, filed or deposited pursuant to any ordi- <br />nance and all rights and obligations thereunder appertaining <br />shall continue in full force and effect. <br /> <br />the <br /> <br /> ADOPTED, this 26th day of O~tober , 1976, by <br />following vote: <br /> COUNCILMEN: Ward, Garthe, Ortiz, Yamamoto, <br /> AYES: Brandt <br /> <br /> NOES: COUNCILMEN: None <br /> <br />ATTEST: <br /> <br />ABSENT: COUNCILMEN: Bricken, Evans <br /> <br />CLERK OF THE COUNCIL <br /> <br />APPROVED AS TO FORM: <br /> <br />KEITH L.
