NS-1359 <br /> <br />AN ORDINANCE OF THE CITY OF SANTA ANA APPROVING <br />AMENDMENT APPLICATION NO. 748 FILED BY LEVITT- <br />WEST AND WILLIAM LYON COMPANY REZONING PROPERTY FROM <br />THE C4 (PLANNED SHOPPING CENTER) DISTRICT TO THE <br />R2-PRD (PLANNED RESIDENTIAL DEVELOPMENT) DISTRICT, <br />AND AMENDING SECTIONAL DISTRICT MAP 27-5-10 <br /> <br /> WHEREAS, the Planning Commission has given notice of <br />and duly held a public hearing on Amendment Application No. 748, <br />filed by Levitt-West and William Lyon Co. to rezone property, <br />generally located on the south side of Warner Avenue between <br />Fairview and Greenville streets from the C4 (Planned Shopping <br />Center) District to the R2-PRD (Planned Residential Development) <br />District, and said Commission has recommended approval of said <br />application; and <br /> <br /> WHEREAS, the City Council regularly held a public hear- <br />ing on said reclassification on published notice required by law, <br />and does now find that the public necessity, convenience, and <br />general welfare require that the said property be reclassified <br />from the C4 (Planned Shopping Center) District to the R2-PRD <br />(Planned Residential Development) District, and that such new <br />classification will not be detrimental to the surrounding property; <br /> <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA <br />ANA DOES ORDAIN AS FOLLOWS: <br /> <br /> SECTION l: That the real property in the City of Santa <br />Ana, County of Orange, California, des:cribed as: <br /> <br />That certain land in the City of Santa Ana, County <br />of Orange, State of California, shown as Parcels 1 <br />and 2 on a map filed in book 36, page 46 of Parcel <br />Maps in the Office of the County Recorder of said <br />County; except therefrom that portion thereof lying <br />westerly of the following described line: beginning <br />at a point on the south line of said Parcel 1, <br />N88o 59~'45"E 170.00 feet from the southwest corner <br />of said Parcel l; thence parallel with the west <br />line of said Parcel I NI°OO'15"W 527.77 feet; thence <br />N88°59'45"E 175.00 feet; thence Nl°OO'lS"W 180.00 <br />feet to the north line of said Parcel 1, <br /> <br />is hereby reclassified from the C4 (P!anned Shopping Center) Dis- <br />trict to the R2-PRD (Planned Residential Development) District, <br />and that Sectional District Map 27-5-10 is hereby amended to show <br />said reclassification, in accordance with Exhibit A.A. 748-A. <br /> <br /> SECTION 2: Neither the adoption of this ordinance nor <br />the repeal hereby of any ordinance shall in any manner affect <br />the prosecution for violation of ordinances, which violations <br />were committed prior to the effective date hereof, nor be con- <br />strued as affecting any of the provisions of such ordinance re- <br />lating to the collection of any such license or penalty or the <br />penal provisions applicable to any violation thereof, nor to <br />affect the validity of any bond or cash deposit in lieu thereof, <br />required to be posted, filed or deposited pursuant to any ordi- <br />nance and all rights and obligations thereunder appertaining <br />shall continue in full force and effect. <br /> <br /> <br />
