NS-1366 <br /> <br />AN ORDINANCE OF THE CITY OF SANTA ANA <br />APPROVING AMENDMENT APPLICATION 764 TO <br />REZONE PROPERTY LOCATED AT FAIRVIEW STREET <br />AND MACARTHUR BOULEVARD FROM THE R2-PRD <br />(PLANNED RESIDENTIAL DEVELOPMEN~ DISTRICT <br />TO THE C4 (PLANNED SHOPPING CENTER) DISTRICT <br />AND AMENDING SECTIONAL DISTRICT MAPS 27-5-10 <br />AND 34-5-10 <br /> <br /> WHEREAS, the Planning Commission has given <br />notice and duly held a public hearing on Amendment Applica- <br />tion 764, filed by C. J. Segerstrom and Sons to rezone property <br />located at the southeast corner of Fairview Street and Mac- <br />Arthur Boulevard from the R2-PRD (Planned Residential De- <br />velopment) District to the C4 (Planned Shopping Center) Dis- <br />trict, and said Commission has recommended approval of the <br />said application, and <br /> <br /> WHEREAS, the City Council regularly held a public <br />hearing on said reclassification on published notice required <br />by law, and does now find that the public necessity, conven- <br />ience, and general welfare require that said property be re- <br />classified from the R2-PRD (Planned Residential Development) <br />District to the C4 (Planned Shopping Center) District, and <br />that such new classification will not be detrimental to the <br />surrounding property, and <br /> <br /> WHEREAS, this Council, prior to taking this action <br />has reviewed and considered the information contained in that <br />Environmental Impact Report designated as "Environmental Im- <br />pact Report 76-4", has approved said document as the final <br />environmental impact report for the General Plan amendment <br />hereby adopted, and finds that social and economic conditions <br />render infeasible the alternative of retaining the parcels <br />in their existing land use designations, <br /> <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA DOES ORDAIN AS FOLLOWS: <br /> <br /> SECTION 1: That the real property located in the <br />City of Santa Ana, described on Exhibit AA 764-A on file in <br />the records of the Planning Director, is hereby reclassified <br />from the R2-PRD (Planned Residential Development) District <br />to the C4 (Planned Shopping Center) District, and that Sec- <br />tional District Maps 27-5-10 and 34-5-10 are hereby amended <br />to show such reclassification in accordance with Exhibit <br />AA 764-A. <br /> <br /> SECTION 2: If any section, subsection, sentence, <br />clause, phrase or portion of this ordinance is for any rea- <br />son held to be invalid or unconstitutional by the decision <br />of any court of competent jurisdiction, such decision shall <br />not affect the validity of the remaining portions of this <br />ordinance. The City Council of the City of Santa Ana hereby <br />declares that it would have adopted this ordinance and each <br />section, subsection, sentence, clause, phrase or portion <br /> <br /> <br />
