<br />AN ORDINANCE OF THE CITY OF SANTA ANA AMEND-
<br />ING ORDINANCE NO. NS-1341 AND APPROVING
<br />AMENDMENT APPLICATION NO. 753 INITIATED BY
<br />THE PLANNING COMMISSION REZONING PROPERTY
<br />FROM THE R3-HDII, Cl-HDII, C2-HDII, AND
<br />P-HDII, AND 0 DISTRICTS TO THE SD (SPECIFIC
<br />DEVELOPMENT) DISTRICT, AND AMENDING SECTIONAL
<br />DISTRICT MAP 12-5-10
<br />
<br /> WHEREAS, Ordinance No. NS-1341, adopted by the
<br />City Council on December 20, 1976, contained an incorrect
<br />legal description, and
<br />
<br /> WHEREAS, the Planning Commission initiated Amend-
<br />ment Application No. 753 to rezone property generally located
<br />between Ross, Van Ness, First, and Third Streets from the
<br />R3-HDII, Cl-HDII, C2-HDII, P-HDII and O Districts to the
<br />SD (Specific Development) District, and said Commission recom-
<br />mended approval of said application after notice and hearing
<br />thereon, and
<br />
<br /> WHEREAS, the City Council regularly held a public
<br />hearing on said reclassification on published notice required
<br />by law, and does now find that the public necessity, conven-
<br />ience, and general welfare require that the said property
<br />be reclassified from the R3-HDII, Cl-HDII, C2-HDII, P-HDII,
<br />and 0 Districts to the SD (Specific Development) District,
<br />and that such new classification will not be detrimental
<br />to the surrounding property, and
<br />
<br /> WHEREAS, the City Council, prior to taking this
<br />action, reviewed and considered the information in the En-
<br />vironmental Impact Report designated as the Redevelopment
<br />Agency's Environmental Impact Report, prepared and certified
<br />by the Santa Ana Redevelopment Agency as the lead agency
<br />for the project proposed for the subject property,
<br />
<br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
<br />SANTA ANA DOES ORDAIN AS FOLLOWS:
<br />
<br /> SECTION 1: That Ordinance No. NS-1341, adopted
<br />December 20, 1976, is hereby amended to read as follows:
<br />
<br /> That the real property commonly known as the Senior
<br />Citizen's Housing Project, bounded by First, Ross, Third
<br />and Van Ness Streets and more particularly described on at-
<br />tached exhibit A, incorporated by reference herein, is here-
<br />by reclassified from the R3-HDII, C1-HDII, C2-HDII, P-HDII,
<br />and O Districts to the SD (Specific Development) District,
<br />and that Sectional District Map 12-5-10 is hereby amended
<br />to show said reclassification, in accordance with Exhibit
<br />A.A. 753-A.

<br /> SECTION 2: If any section, subsection, sentence,
<br />clause, phrase or portion of this ordinance is for any rea-
<br />son held to be invalid or unconstitutional by the decision
<br />of any court of competent jurisdiction, such decision shall
<br />not affect the validity of the remaining portions of this
<br />ordinance. The City Council of the City of Santa Ana hereby
<br />declares that it would have adopted this ordinance and each
<br />section, subsection, sentence, clause, phrase or portion
<br />
