NS-1379 <br /> <br />AN ORDINANCE OF THE CITY OF SANTA ANA <br />APPROVING AMENDMENT APPLICATION NO. 767 <br />FILED BY BERNARD & SPENGLER TO REZONE <br />PROPERTY ON THE EAST SIDE OF FAIRVIEW <br />STREET BETWEEN SEVENTEENTH STREET AND <br />EDNA DRIVE FROM THE LP (LIMITED PRO- <br />FESSIONAL) AND C 1 (COMMUNITY COMMERCIAL) <br />DISTRICTS TO THE R 1 (SINGLE FAMILY RESI- <br />DENCE) DISTRICT AND AMENDING SECTIONAL <br />DISTRICT MAP 2-5-10. <br /> <br /> WHEREAS, the real property located on the east side <br />of Fairview Street between Seventeenth Street and Edna Drive <br />in the City of Santa Aha and more particularly described infra, <br />is located within the LP (Limited Professional) and C 1 <br />(Community Commercial) districts; and <br /> <br /> WHEREAS, an application has been filed to amend <br />Sectional District Map 2-5-10 to rezone such real property to <br />the R 1 (Single-Family Residence)district; and <br /> <br /> WHEREAS, the Planning Commission has given notice <br />of and duly held a public hearing on Amendment Application <br />No. 767 to rezone such real property from the LP (Limited <br />Professional) and C 1 (Community Commercial) Districts to the <br />R 1 (Single-Family Residence) District and has recommended <br />approval of said application; and <br /> <br /> WHEREAS, the City Council regularly held a public <br />hearing on said reclassification on published notice as required <br />by law and does now find that the public necessity, convenience, <br />and general welfare require that said property be reclassified <br />from the LP (Limited Professional) and C 1 (Community Commercial) <br />to the R 1 (Single-Family Residence) District, and that the new <br />classification will not be detrimental to the surrounding <br />property; and <br /> <br /> WHEREAS, prior to taking this action, the City Council <br />has reviewed and considered the information contained in Nega- <br />tive Declaration No. 77-150, and, on the basis thereof, finds <br />that the project will not have a significant effect upon the <br />environment, <br /> <br /> NOWt THEREFORE v THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA DOES ORDAIN AS FOLLOWS: <br /> <br /> SECTION 1: That the real property situated in the <br />City of Santa Ana, County of Orange, State of California, <br />generally located at the east side of Fairview Street between <br />Seventeenth Street and Edna Drive, and more particularly des- <br />cribed as the west 137.5 feet of Tract No. 9631 as recorded in <br />Book 411, pages 11 through 14 inclusive, of Tract Maps, Records <br />of Orange County, State of California, is hereby reclassified <br />from the LP (Limited Professional) and C 1 (Community Commercial) <br />Districts to the R 1 (Single Family Residence) District, and <br />that Sectional District Map 2-5-10 is hereby amended to show said <br />reclassification, in accordance with Exhibit AA 767A. <br /> <br /> SECTION 2: Neither the adoption of this Ordinance <br />nor the repeal hereby of any ordinance shall in any manner <br />affect the prosecution for violation of ordinances, which violations <br />were committed prior to the effective date hereof, nor be construed <br />as affecting any of the provisions of such ordinance relating to <br />the collection of any such license or penalty or the penal pro- <br />visions applicable to any violations thereof, nor to affect the <br />validity of any bond or cash deposit in lieu thereof, required to <br /> <br /> <br />
