NS-1381 <br /> <br />AN ORDINANCE OF THE CITY OF SANTA ANA ADDING <br />ARTICLE IV, CONSISTING OF SECTIONS 17-60, 17-61, <br />AND 17-62, TO CHAPTER 17 OF THE SANTA ANA MUNI- <br />CIPAL CODE, PROVIDING FOR URGENCY ABATEMENT OF <br />PUBLIC NUISANCES <br /> <br /> THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN <br />AS FOLLOWS: <br /> <br /> SECTION 1: That Article IV, consisting of Sections <br />17-60, 17-61, and 17-62, is hereby added to Chapter 17 of the Santa <br />Ana Municipal Code, to read as follows: <br /> <br />ARTICLE IV. URGENCY ABATEMENT <br /> <br />Sec. 17-60. Scope. <br /> <br /> A public nuisance may be abated pursuant to this Arti- <br />cle if it must be abated immediately in order to avoid an imminent <br />detriment to the public health, safety, or welfare. <br /> <br />Sec. 17-61. Abatement. <br /> <br /> Every person, within twenty-four (24) hours after being <br />notified by the director of public works, sanitation inspector, <br />health officer, chief of police, fire chief, or their designated <br />representatives, to do so, shall abate any public nuisance existing <br />on any premises owned or occupied by the~, and in case of refusal or <br />neglect to do so, such official may cause such nuisance to be <br />abated by the City and the cost of such abatement may be recovered <br />from the owner of the premises pursuant to Section 17-62. <br /> <br />Sec. 17-62. <br /> <br /> Upon abatement by the City, the official causing such <br />abatement may initiate assessment proceedings pursuant to Article <br />III of this Chapter. The assessment report shall include a des- <br />cription of the location, nature, and extent of the public nui- <br />sance and the reasons for urgency abatement under this Article. <br />The hearing on the assessment shall extend to and include the ques- <br />tion of whether the conditions abated did in fact constitute a <br />public nuisance. No assessment report shall be confirmed except <br />upon a finding that the conditions abated did in fact constitute a <br />public nuisance. <br /> <br /> SECTION 2: If any section, subsection, sentence, clause, <br />phrase or portion of this ordinance is for any reason held to be <br />invalid or unconstitutional by the decision of any court of compe- <br />tent jurisdiction, such decision shall not affect the validity of <br />the remaining portions of this ordinance. The City Council of <br />the City of Santa Ana hereby declares that it would have adopted <br />this ordinance and each section, subsection, sentence, clause, <br />phrase or portion thereof irrespective of the fact that any one <br />or more sections, subsections, sentences, clauses, phrases or por- <br />tions be declared invalid or unconstitutional. <br /> <br /> ADOPTED, this 19th day of September , 1977, <br />by the following vote: <br /> <br /> <br />
