ORDINANCE NO. NS-1389.1 <br /> <br />AN EMERGENCY ORDINANCE OF THE CITY OF <br />SANTA ANA AMENDING VARIOUS SECTIONS OF <br />THE SANTA ANA MUNICIPAL CODE REGULATING <br />BINGO GAMES TO MAKE SAID SECTIONS COMPLY <br />WITH STATE LAW, AND STATING THE REASON <br />FOR ITS URGENCY <br /> <br /> THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN <br />AS FOLLOWS: <br /> <br /> SECTION 1: That Section 10-59 of the Santa Ana Municipal <br />Code is hereby amended to read as follows: <br /> <br />Section 10-59. Bingo License Required. <br /> <br /> No person or organization shall organize, conduct or <br />operate a bingo game without having first procured and maintained a <br />license issued by the City of Santa Ana pursuant to the provisions <br />of this Code. <br /> <br /> SECTION 2: That Section 10-59.1 of the Santa Aha Muni- <br />cipal Code is hereby amended to read as follows: <br /> <br />Section 10-59.1. Organizations Eligible for City License <br /> to Conduct Bingo Games. <br /> <br />(a) <br /> <br />Organizations exempted from the payment of the bank <br />and corporation tax by Sections 23701 a, 23701 b, <br />23701 d, 23701 e, 23701 f, 23701 g, and 23701 1 of <br />the Revenue and Taxation Code and mobile home park <br />associations and senior citizens organizations are <br />eligible to apply to the city for a license to con- <br />duct bingo games in the City of Santa Ana under <br />the provisions of Section 326.5 of the Penal Code <br />as amended and the provisions of the Santa Ana Muni- <br />cipal Code relating to bingo, provided that the <br />proceeds of such ga~es are used only for charitable <br />purposes. <br /> <br />(b) Any license issued pursuant to this section shall <br /> be valid for one year from the date of issuance. <br /> <br /> SECTION 3: This Council finds that this ordinance is <br />urgently required as an emergency ordinance for the immediate <br />preservation of the public peace, health, and safety for the follow- <br />ing reasons: <br /> <br /> In order for this ordinance to properly implement the <br />constitutional amendment to Section 19 of Article IV of the Califor- <br />nia Constitution, permitting bingo, which the people of California <br />approved at the June 1976 primary, and Assembly Bill No. 101, Chap- <br />ter 271, Statutes of 1977, approved by the Governor July 7, 1977, <br />filed with the Secretary of State July 8, 1977, as an urgency sta- <br />tute, it is necessary for this ordinance to take effect immediately. <br /> <br /> <br />
