NS-1414 <br />PAGE TWO <br /> <br />of private sewage disposal facilities abandoned con- <br />sequent to such connection is included in the building <br />sewer permit. <br /> <br /> SECTION 3: That section 8-311 of the Santa Ana Municipal <br />Code, is hereby amended to read as follows: <br /> <br />Sec. 8-311. Application for permit. <br /> <br />Any person legally entitled to apply for and receive a <br />permit shall make such application on forms provided <br />for that purpose. He shall give a description of the <br />character of the work proposed to be done, and the <br />location, ownership, occupancy and the use of the <br />premises in connection therewith. The administrative <br />authority may require plans, specifications or drawings <br />and such other information as he may deem necessary. <br /> <br />If the administrative authority determines that the <br />plans, specifications, drawings, descriptions or in- <br />formation furnished by the applicant is in compliance <br />with this code, he shall issue the permit applied for <br />upon payment of the required fee as hereinafter fixed. <br /> <br />Every applicant for a permit to do work regulated by <br />this code shall state in writing on the application <br />form provided for that purpose, the character of work <br />proposed to be done and the amount and kind in con- <br />nection therewith, together with such information, <br />pertinent thereto as may be required. <br /> <br /> SECTION 4: That section 8-312 of the Santa Ana Municipal <br />Code, is hereby amended to read as follows: <br /> <br />Sec. 8-312. Fees. <br /> <br />Fees and charges for permits, plan checks, reinspeotions, <br />and investigations shall be established and regulated <br />by resolution of the City Council. <br /> <br /> SECTION 5: That sections 8-313, 8-314, 8-315, 8-316, <br />and 8-370 of the Santa Ana Municipal Code are hereby repealed. <br /> <br /> SECTION 6: If any section, subsection, sentence, <br />clause, phrase or portion of this ordinance is for any <br />reason held to be invalid or unconstitutional by the de- <br />cision of any court of competent jurisdiction, such decision <br />shall not affect the validity of the remaining portions of <br />this ordinance. The City Council of the City of Santa Ana <br />hereby declares that it would have adopted this ordinance <br />and each section, subsection, sentence, clause, phrase or <br />portion thereof irrespective of the fact that any one or <br />more sections, subsections, sentences, clauses, phrases or <br />portions be declared invalid or unconstitutional. <br /> <br /> SECTION 7: Neither the adoption of this ordinance nor <br />the repeal hereby of any ordinance shall in any manner <br />affect the prosecution for violation of ordinances, which <br />violations were committed prior to the effective date hereof, <br />nor be construed as affecting any of the provisions of such <br />ordinance relating to the collection of any such license or <br />penalty or the penal provision applicable to any violation <br />thereof, nor to affect the validity of any bond or cash <br />deposit in lieu thereof, required to be posted, filed or <br />deposited pursuant to any ordinance and all rights and <br />obligations thereunder appertaining shall continue in full <br />force and effect. <br /> <br />-2- <br /> <br /> <br />
