SECTION 3: That section 8-311 of the Santa Ana Municipal Code, is hereby amended to read as follows: Sec. 8-311. Application for permit. Any person legally entitled to apply for and receive a permit shall make such application on forms provided for that purpose. He shall give a description of the character of the work proposed to be done, and the location, ownership, occupancy and the use of the premises in connection therewith. The administrative authority may require plans, specifications or drawings and such other information as he may deem necessary. If the administrative authority determines that the plans, specifications, drawings, descriptions or in- formation furnished by the applicant is in compliance with this code, he shall issue the permit applied for upon payment of the required fee as hereinafter fixed. Every applicant for a permit to do work regulated by this code shall state in writing on the application form provided for that purpose, the character of work proposed to be done and the amount and kind in con- nection therewith, together with such information, pertinent thereto as may be required. SECTION 4: That section 8-312 of the Santa Ana Municipal Code, is hereby amended to read as follows: Sec. 8-312. Fees. Fees and charges for permits, plan checks, reinspeotions, and investigations shall be established and regulated by resolution of the City Council. SECTION 5: That sections 8-313, 8-314, 8-315, 8-316, and 8-370 of the Santa Ana Municipal Code are hereby repealed. SECTION 6: If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the de- cision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Santa Ana hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases or portions be declared invalid or unconstitutional. SECTION 7: Neither the adoption of this ordinance nor the repeal hereby of any ordinance shall in any manner affect the prosecution for violation of ordinances, which violations were committed prior to the effective date hereof, nor be construed as affecting any of the provisions of such ordinance relating to the collection of any such license or penalty or the penal provision applicable to any violation thereof, nor to affect the validity of any bond or cash deposit in lieu thereof, required to be posted, filed or deposited pursuant to any ordinance and all rights and obligations thereunder appertaining shall continue in full force and effect. -2-
