NS-1447 <br /> <br />AN EMERGENCY ORDINANCE OF THE CITY OF SANTA <br />ANA PROHIBITING ISSUANCE OF BUILDING PERMITS, <br />VARIANCES, CONDITIONAL USE PERMITS, OR MINOR <br />EXCEPTIONS IN THE AREA GENERALLY BOUNDED BY <br />THE SANTAANA FREEWAY ON THE NORTH, LINCOLN <br />AVENUE ON THE EAST, SANTA ANA BLVD. ON THE <br />SOUTH, AND SANTIAGO AVENUE ON THE WEST, EXCEPT <br />UNDER SPECIFIED CONDITIONS FOR AN INTERIM <br />PERIOD PENDING AMENDMENT OF THE GENERAL PLAN AND <br />THE MUNICIPAL CODE; AND STATING THE REASONS FOR <br />ITS URGENCY <br /> <br /> THE CITY COUNCIL OF THE CITY OF SA/qTA ANA DOES <br />ORDAIN AS FOLLOWS: <br /> <br /> SECTION 1: Except as hereafter provided, the <br />issuance of building permits pursuant to Chapter 8 of the <br />Santa Ana Municipal Code, or the granting of minor exceptions, <br />variances or conditional use permits pursuant to Chapter 41 <br />of the Santa Ana Municipal Code, is hereby prohibited in the <br />area generally bounded by the Santa Ana Freeway on the north, <br />Lincoln Avenue on the east, Santa Ana Blvd. on the south, <br />Santiago Avenue to civic Center Drive on the southwest, 190 <br />feet east of the centerline of Santiago Avenue on the west, <br />and 384 feet east of the centerline of Santiago Avenue on the <br />northwest, hereinafter referred to as "the Logan Area" and <br />more fully delineated on the map marked "Exhibit A," attached <br />hereto and incorporated herein by reference, during the effec- <br />tive period of this ordinance. <br /> <br /> SECTION 2: Notwithstanding any provision herein to <br />the contrary, any building permit authorized by Chapter 8 of <br />the Santa Ana Municipal Code, or minor exceptions, variances, <br />or conditional use permits authorized by Chapter 41 of the <br />Santa Ana Municipal Code, may be issued within the Logan Area <br />where the property involved is residential in character, or <br />where the proposed construction, alteration or repair does <br />not exceed five thousand dollars ($5,000.00) in value, or <br />where an emergency as determined by the appropriate issuing <br />authority exists. <br /> <br /> SECTION 3: This ordinance shall be effective for <br />a period of four (4) months commencing on the date of adoption <br />unless extended, repealed or modified by ordinance adopted <br />by this Council. <br /> <br /> SECTION 4: This Council finds that this ordinance <br />is urgently required as an emergency ordinance for the imme- <br />diate preservation of the public peace, health, and safety <br />for the following reasons: <br /> <br /> (a) An Environmental Impact Report is presently <br />under preparation for the potential rezoning of the Logan <br />area, General Plan amendment and change of specific street <br />alignment for Civic Center Drive East; <br /> <br /> (b) The issuance of permits pursuant to Chapter <br />8 of the Santa Ana Municipal Code or minor exceptions, <br />variances or conditional use permits pursuant to Chapter 41 <br />of the Santa Aha Municipal Code may have an adverse effect <br />on the proposed development of the Logan area as a residen- <br />tial community; <br /> <br /> (c) Amendment of the General Plan and the zoning <br />provisions of the Santa Ana Municipal Code may be required <br />to regulate the location of uses in the Logan Area in order <br />to avoid or mitigate such adverse effects; <br /> <br /> <br />
