ORDINANCE NO. NS-1462 <br />PAGE TWELVE <br /> <br />Any person who shall violate any of the provisions of this <br />code hereby adopted or fail to comply therewith, or who <br />shall violate or fail to comply with any order made under <br />this code, or who shall build in violation of any detailed <br />statement of specifications or plans submitted and approved <br />hereunder, or any certificate or permit issued hereunder, <br />and from which no appeal has been taken, or who shall fail <br />to comply with such an order as affirmed or modified by the <br />city council or by a court of competent jurisdiction, within <br />the time fixed herein, shall severally for each and every <br />violation and non-compliance, respectively, be guilty of a <br />midemeanor, punishable by a fine of not more than five <br />hundred dollars ($500.00) or by imprisonment for not more <br />than six (6) months, or by both such fine and imprisonment. <br />The imposition of one penalty for any violation shall not <br />excuse the violation or permit it to continue; and all such <br />persons shall be required to correct or remedy such violations <br />or defects within a reasonable time; and when not otherwise <br />specified, each day prohibited conditions are maintained <br />shall constitute a separate offense. The application of the <br />above penalty shall not be held to prevent the enforced <br />removal of prohibited conditions. <br /> <br /> SECTION 14: That Section 14-7 of the Santa Ana <br />Municipal Code, is hereby amended to read as follows: <br /> <br />Sec. 14-7. <br /> <br />Access Roadways for Fire Apparatus. <br />(Section 13.208(a)) <br /> <br /> Section 13.208(a) of the Uniform Fire Code is <br />amended to read as follows: <br /> <br /> Every building or portions of buildings hereafter <br />constructed shall have fire apparatus access roadways. Such <br />access roadways shall provide two (2) separate but interconnected <br />means of ingress and egress. Access shall be at least <br />twenty (20) feet in clear width. A fifty (50) foot outside <br />and thirty (30) foot inside radius shall be provided wherever <br />they make a turn. The total width shall be continuously <br />paved to accommodate forty thousand (40,000) pounds and <br />shall not exceed the angle of departure for fire apparatus <br />on any slope. Access roadways shall have a vertical clear~.ance <br />of not less than thirteen (13) feet six (6) inches above the <br />finished driveway surface. <br /> <br /> SECTION 15: That sections 14-2, 14-6, 14-12, <br />14-13, and 14-22 of the Santa Ana Municipal Code are hereby <br />repealed. <br /> <br /> SECTION 16: If any section, subsection, sentence, <br />clause, phrase or portion of this ordinance is for any <br />reason held to be invalid or unconstitutional by the decision <br />of any court of competent jurisdiction, such decision shall <br />not affect the validity of the remaining portions of this <br />ordinance. The City Council of the City of Santa Ana hereby <br />declares that it would have adopted this ordinance and each <br />section, subsection, sentence, clause, phrase or portion <br />thereof irrespective of the fact that any one or more sections, <br />subsections, sentences, clauses, phrases, or portions be <br />declared invalid or unconstitutional. <br /> <br /> SECTION 17: Neither the adoption of this ordinance <br />nor the repeal hereby of any ordinance shall in any manner <br />affect the prosecution for violation of ordinances, which <br />violations were committed prior to the effective date hereof, <br />nor be construed as affecting any of the provisions of such <br />ordinance relating to the collection of any such license or <br />penalty or the penal provision applicable tO any violation <br />thereof, nor to affect the validity of any bond or cash <br />deposit in lieu thereof, required to be posted, filed or <br /> <br />-12- <br /> <br /> <br />
