ORDINANCE NO. NS- ] 503 <br />PAGE FOUR <br /> <br />ARTICLE II. <br /> <br />FLOOD-PLAN CONSTRUCTION <br />STANDARDS <br /> <br />DIVISION 1. <br /> <br />IN GENERAL <br /> <br />Sec. 7-21. <br /> <br />Permit requirement <br /> <br /> (a) No building permit required by Article II of <br />Chapter 8 of this Code shall be issued for any new construction <br />or other development in the A, A0, or Al6 zones which fails <br />to comply with the requirements of this Chapter. <br /> <br /> (b) No permit required for the installation of a <br />mobilehome, for which the Director of Building Safety is the <br />enforcement authority, under Division 13 of the Health and <br />Safety Code of the State of California, shall be issued for <br />the placement of a mobile home in the A0 zone which fails to <br />comply with the requirements of this Chapter. <br /> <br /> (c) Any proposed construction or other development <br />(other than public works construction) in the A, A0, or Al6 <br />zones, including the placement of mobile homes, for which a <br />permit is not required under either subsection (a) or subsection <br />(b), shall nevertheless require a permit from the Director <br />of Building Safety, and no such permit shall be issued for <br />any such construction, development, or placement which fails <br />to comply with the requirements of this Chapter. <br />The Director Building Safety shall develop such forms and <br />procedures as may be necessary for the implementation of <br />this subsection. <br /> <br />Sec. 7-22. <br /> <br />Violation a misdemeanor. <br /> <br /> Any person who does or causes to be done any <br />construction or other development in the A, A0, or Al6 zone, <br />or who places any mobile home in any such zone, without <br />having first obtained the permit required by section 7-21, <br />is guilty of a misdemeanor. <br /> <br />Sec. 7-23. <br /> <br />Review of permit applications for <br />State and Federal law requirements. <br /> <br /> The Director of Building Safety shall review all <br />permit applications submitted pursuant to section 7-21 to <br />assure that all necessary permits have been received from <br />those governmental agencies from which approval is required <br />by Federal or State law, including section 404 of the Federal <br />Water Pollution Control Act of 1972, 33 U.S.C. 1334. <br /> <br />Sec. 7-24. <br /> <br />General standards for new construction <br />or improvement of structures. <br /> <br /> No permit for new construction or substantial <br />improvements of structures (including the placement of <br />prefabricated buildings and mobile homes) shall be approved <br />in the A, A0, or Al6 zones unless all of the following <br />standards are met: <br /> <br /> (1) The structure must be designed or modified, <br />and adequately anchored, to prevent flotation, collapse, or <br />lateral movement. <br /> <br /> (2) The structure must be constructed with materials <br />and utility equipment resistant to flood damage. <br /> <br /> (3) The structure must be constructed by methods <br />and practices that minimize flood damage. <br /> <br /> <br />
