NS-]503 <br />PAGE SEVEN <br /> <br />Sec. 7-35. <br /> <br />Al6 Zone - Residential structures. <br /> <br /> (a) Ail new construction and substantial improvements <br />of residential structures (other than mobile homes) within <br />the Al6 zone must have the lowest floor (including basement) <br />elevated to or above the base flood level shown on the Flood <br />Insurance Rate Maps. <br /> <br />(b) Mobile homes may not be placed in the Al6 zone. <br /> <br />Sec. 7-36. <br /> <br />Al6 Zone - Nonresidential structures. <br /> <br /> Ail new construction and substantial improvements <br />of nonresidential structures in the Al6 zone must either: <br /> <br /> (1) have the lowest floor (including basement) <br />elevated to or above the base flood level shown on the Flood <br />Insurance Rate Maps; or <br /> <br /> (2) together with attendant utility and sanitary <br />facilities, be designed so so that below the base flood <br />level the structure is watertight with walls substantially <br />impermeable to the passage of water and with structural <br />components having the capability of resisting hydrostatic <br />and hydrodynamic loads and effects of buoyancy. <br /> <br />Sec. 7-37 A Zone. <br /> <br /> (a) Residential structures and mobile homes may <br />not be constructed or placed in the A Zone. <br /> <br /> (b) Ail new construction or substantial improvements <br />of nonresidential structures in the A zone must have the <br />lowest floor (including basement) elevated or flood-proofed <br />to or above the base flood level. Any base flood elevation <br />data available from a federal, state, or other source shall <br />be obtained, reviewed, and reasonably utilized prior to <br />issuance of any permit for such construction. <br /> <br />DIVISION 3. <br /> <br />VARIANCES <br /> <br />Sec. 7-41. Grounds for issuance. <br /> <br /> The Director of Building Safety may grant a variance <br />from the requirements of this part if he makes written <br />findings that the following requirements are satisfied: <br /> <br /> (1) The new construction or substantial improvements <br />are to be erected on a lot of one-half acre or less in size, <br />contiguous to and surrounded by lots with existing structures <br />constructed below the base flood level; <br /> <br />(2) The applicant has shown good and sufficient <br /> <br />cause; <br /> <br /> (3) Failure to grant the variance would result in <br />exceptional hardship to the applicant; <br /> <br /> (4) The granting of the variance will not result <br />in increased flood heights, additional threats to public <br />safety, extraordinary public expense, creation of nuisances, <br />fraud on or victimization of the public, or conflict with <br />other City ordinances; and <br /> <br /> (5) The variance is the minimum necessary considering <br />the flood hazard, to afford relief. <br /> <br /> <br />
