NS- 1520 <br /> <br />AN ORDINANCE OF THE CITY OF SANTA ANA ADDING <br />ARTICLE II TO CHAPTER 18 OF THE SANTA ANA <br />MUNICIPAL CODE PERTAINING TO REGULATION OF <br />SMOKING IN CITY LIBRARIES <br /> <br /> THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN <br />AS FOLLOWS: <br /> <br /> Section 1: That the Santa Ana Municipal Code is <br />hereby amended by adding an article, to be numbered Article II <br />of Chapter 18, which said article reads as follows~ <br /> <br />ARTICLE II <br /> <br />PUBLIC SMOKING REGULATIONS <br /> <br />Sec. 18-39. <br /> <br />Definitions. <br /> <br />"City buildings and facilities" <br />buildings and facilities owned, <br />otherwise occupied by the City. <br /> <br />includes all <br />leased or <br /> <br />"Smoke" or "smoking" as used in this Article II <br />shall include the carrying, holding, possession <br />or smoking of a lighted pipe or cigar or cigar- <br />ette of any kind, or the lighting of a pipe, <br />cigar or cigarette of any kind. <br /> <br />Sec. 18-40. <br /> <br />Prohibition in certain places <br />open to the public. <br /> <br />No person shall smoke in any of the following <br />places within the city buildings and facilities <br />hereinafter specified: <br /> <br />(a) <br /> <br />The public halls, public meeting, reading <br />and reference rooms, and other public areas <br />of main and branch libraries, excepting <br />restroomso <br /> <br />Sec. 18-41 <br /> <br />Duty to post signs. <br /> <br />"No smoking" signs shall be conspicuously posted in <br />every room, building, or other place where smoking <br />is prohibited by this article, by the department <br />head, operator, manager, or other person having con- <br />trol of such room, building, or other place. <br /> <br /> SECTION 2: If any section, subsection, sentence, <br />clause, phrase or portion of this ordinance is for any reason <br />held to be invalid or unconstitutional by the decision of <br />any court of competent jurisdiction, such decision shall not <br />affect the validity of the remaining portions of this ordinance. <br />The City Council of the City of Santa Ana hereby declares <br />that it would have adopted this ordinance and each section, <br />subsection, sentence, clause, phrase or portion thereof <br />irrespective of the fact that any one or more sections, <br />subsections, sentences, clauses, phrases or portions be <br />declared invalid or unconstitutional. <br /> <br /> SECTION 3: Neither the adoption of this ordinance <br />nor the repeal hereby of any ordinance shall in any manner <br /> <br /> <br />
