NS- 1544 <br /> <br />AN ORDINANCE OF THE CITY OF SANTA ANA <br />ADDING SECTION 10-177 TO THE SANTA ANA <br />MUNICIPAL CODE PROHIBITING THE SALE OF <br />PRESSURIZED CANS CONTAINING PAINT TO <br />MINORS AND PROHIBITING POSSESSION OF <br />SUCH CANS IN DESIGNATED PUBLIC PLACES <br /> <br /> THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES <br />ORDAIN AS FOLLOWS: <br /> <br /> SECTION 1: That the Santa Ana Municipal Code, is <br />hereby amended by adding a section, to be numbered 10-177, <br />which said section reads as follows: <br /> <br />Sec. 10-177 <br /> <br />Sale and Possession of Pressurized <br />Paint Cans <br /> <br />(a) No person shall sell any pressurized can containing any <br />substance commonly known as paint or dye to anyone under the <br />age of eighteen (18) years and no person under the age of <br />eighteen (18) years shall purchase any pressurized can con- <br />taining paint or dye. <br /> <br />(b) No person shall have in his or her possession any pres- <br />surized can containing any substance commonly known as paint <br />or dye while in any public park, playground, swimming pool, <br />recreational facility, or zoo in the City of Santa Ana. This <br />section shall not apply to authorized employees of the City <br />of Santa Aha or an individual or authorized employee of an <br />individual, agency or company under contract with the City of <br />Santa Ana. <br /> <br /> SECTION 2: If any section, subsection, sentence, <br />clause, phrase or portion of this ordinance is for any reason <br />held to be invalid or unconstitutional by the decision of any <br />court of competent jurisdiction, such decision shall not <br />affect the validity of the remaining portions of this ordinance. <br />The City Council of the City of Santa Ana hereby declares <br />that it would have adopted this ordinance and each section, <br />subsection, sentence, clause, phrase or portion thereof irre- <br />spective of the fact that any one or more sections, subsections, <br />sentences, clauses, phrases, or portions be declared invalid <br />or unconstitutional. <br /> <br /> ADOPTED this 6th day of 0ct0ber , 1980, <br />by the following vote: <br /> <br />AYES: COUNCILMEN: <br />NOES: COUNCILMEN: <br /> <br />Bricken, Luxembourger, Serrato, <br /> Yamamoto <br />Markel, Ward <br /> <br />ABSENT: COUNCILMEN: Griset <br /> <br />ATTEST: <br /> <br /> MAYOR <br />ERK OF THE COUNC <br /> <br />EDWARD J. ~00~, City Attorney <br /> <br /> <br />
