EJC: adg <br />12/22/80 <br /> <br />ORDINANCE NO. NS- 1562 <br /> <br />AN ORDINANCE OF THE CITY OF SANTA ANA <br />PROVIDING THAT CERTAIN RESERVE PEACE <br />OFFICERS SHALL HAVE THE POWERS OF A <br />REGULAR POLICE OFFICER <br /> <br /> WHEREAS, Assembly Bill 3217 provides for further <br />requirements for reserve police officers with respect to <br />training by amending California Penal Code Sections 830.6 <br />and 832.6. <br /> <br /> WHEREAS, said Assembly Bill 3217 incorporates in <br />Section 832.6 of the Penal Code provisions that, despite <br />those new requirements, a person who has been issued a Level <br />I Reserve Officers Certificate by the Commission on Peace <br />Officers Standards and Training on or before January 1, <br />1981, shall have the full powers of a Peace Officer if the <br />local agency adopts an ordinance approving such, either <br />individually or by class, where the appointing authority of <br />such persons determines that such a person is qualified by <br />reason of their training and experience; and <br /> <br /> WHEREAS, the City Council is desirous of following <br />such provision and permitting such persons to retain their <br />status and powers as a peace officer. <br /> <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF <br />SANTA ANA DOES ORDAIN AS FOLLOWS: <br /> <br /> SECTION 1: Ail reserve police officers of the <br />City of Santa Ana who have been issued a Peace Officers <br />Standards and Training Level I Reserve Officer Certificate <br />prior to January 1, 1981, shall have the full powers of a <br />peace officer, where the City Manager, on the recommendation <br />of the Chief of Police, has determined such reserve officer <br />qualified to perform general law enforcement duties by <br />reason of such reserve officers training and experience. <br /> <br /> SECTION 2: This ordinance retains in the Chief <br />of Police the authority, control and command over the <br />reserve police force and permits the adoption of rules and <br />regulations limiting or designating the extent of authority <br />of the various activities of the reserve officers. <br /> <br /> ADOPTED this 17th day of February · <br />1981, by the following vote: <br /> <br />AYES: COUNCILMEN: <br />NOES: COUNCILMEN: <br /> <br />Bricken, Griset, Luxembourger, Markel, <br /> Serrato, Ward, Yamamoto <br />None <br /> <br />ABSENT: COUNCILMEN: None <br /> <br />ATTEST: <br /> <br />CITY ATTORNEY <br /> <br /> <br />
