REL:jd <br />9/4/81 <br /> <br />ORDINANCE NO. NS- 1601 <br /> <br />AN ORDINANCE OF THE CITY OF SANTA ANA ADDING SECTION <br />7-9 TO THE SANTA ANA MUNICIPAL CODE TO APPLY REGULATORY <br />FLOODWAY LAND USE RESTRICTIONS TO ALL LAND WITHIN THE <br />BOUNDARIES OF THE SANTA ANA RIVER FEDERAL FLOOD <br />CONTROL PROJECT <br /> <br /> THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES <br />ORDAIN AS FOLLOWS: <br /> <br /> Section 1: That the Santa Ana Municipal Code is <br />hereby amended by adding a section, to be numbered 7-9, <br />which said section reads as follows: <br /> <br />Sec. 7-9. Regulation of Santa Ana River <br /> Federal Project Area <br /> <br /> (a) The purpose of this section is to extend and <br />apply the regulations imposed by this chapter on land within <br />the designated regulatory floodway to all land within the <br />boundaries of the Santa Ana River federal flood control <br />project, in order to comply with the conditions of eligibil- <br />ity of the proposed project for state financial assistance <br />for local costs of land acquisition, easements and right of <br />way under Section 8411 of the Water Code of the State of <br />California. The effect of this section is to add certain <br />land presently used as a golf course and located immediately <br />to the south of Santiago Creek at the point of its junction <br />with the Santa Ana River to the land subjected to regulatory <br />floodway regulations by other provisions of this chapter. <br /> <br /> (b) There is hereby adopted and incorporated by <br />reference that certain collection of maps entitled "Right-of- <br />Way-Map, Santa Ana River" prepared by the Right of Way En- <br />gineering Section of the Orange County Environmental Man- <br />agement Agency, consisting of six maps numbered 8 through <br />13, which maps are on file in the office of the Director of <br />Building Safety. All land shown on said maps as being within <br />the limit of federal project within the City of Santa Ana <br />shall be "land within the boundaries of the Santa Ana River <br />federal flood control project" for purposes of this section. <br /> <br /> (c) Ail land within the boundaries of the Santa <br />Ana River federal flood control project shall be subject to <br />the same requirements and restrictions as imposed on land <br />designated regulatory floodway by other sections of this <br />chapter and by the floodway map adopted by Section 7-2, <br />notwithstanding any other zone designated for any part of <br />said land on the flood insurance rate map adopted by Section <br />7-2. <br /> <br /> Section 2: If any section, subsection, sentence, <br />clause, phrase or portion of this ordinance is for any reason <br />held to be invalid or unconstitutional by the decision of <br />any court of competent jurisdiction, such decision shall not <br />affect the validity of the remaining portions of this or- <br />dinance. The City Council of the City of Santa Ana hereby <br />declares that it would have adopted this ordinance and <br /> <br />-1- <br /> <br /> <br />
