NS- 1614 <br /> <br />AN EMERGENCY ORDINANCE OF THE CITY OF SANTA <br />ANA PROHIBITING ISSUANCE OF PERMITS TO ENGAGE <br />IN THE BUSINESS OF GAMES OF BILLIARDS OR POOL <br />FOR PROFIT FOR AN INTERIM PERIOD PENDING STUDY <br />AND ENACTMENT OF APPROPRIATE ORDINANCES <br /> <br /> THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES <br />ORDAIN AS FOLLOWS: <br /> <br /> SECTION 1: Except as hereinafter provided, the <br />issuance of permits for the conduct of businesses where <br />games of billiards or pool are being operated for profit is <br />hereby prohibited during the effective period of this ordinance. <br /> <br /> SECTION 2: This ordinance shall be effective for <br />a period of four (4) months commencing on the date of adoption <br />unless extended, repealed or modified by ordinance adopted <br />by this Council. <br /> <br /> SECTION 3: This Council finds that this ordinance <br />is urgently required as an emergency ordinance for the immediate <br />preservation of the public peace, health and safety for the <br />following reasons: <br /> <br /> (a) An ordinance is presently being prepared to <br />require permission from the City of Santa Ana to operate an <br />establishment wherein billiard or pool tables are being <br />operated for profit; and <br /> <br /> (b) The conduct of a business wherein billiard or <br />pool tables are being operated for profit ("said business") <br />often creates conditions which are socially unhealthful and <br />not in the best interests of the community; and <br /> <br /> (c) The conduct of said business contributes to <br />criminal or anti-social behavior such as loitering, malicious <br />mischief, disturbing the peace and felonious behavior; and <br /> <br /> (d) Unless prohibited during the period of prep- <br />aration of the licensing ordinance for said business, such <br />use of property is likely to be initiated in conflict with <br />such ordinance as finally enacted. <br /> <br /> THEREFORE, the City Council declares that this <br />ordinance shall take effect, and be adopted as an emergency <br />measure and is to be enforced from the date of publication <br />of title as required by the Charter of the City of Santa <br />Ana. <br /> <br /> ADOPTED, this 21st day of Decembe~ , 1981, <br />by the following vote: <br /> <br />AYES: <br /> <br />NOES: <br /> <br />COUNCILMEMBERS: Acosta, Bricken, Griset, <br /> Luxembourger, Markel, McGuigan, Serrato <br />COUNCILMEMBERS: None <br /> <br />ABSENT: <br /> <br />COUNCILMEMBERS: None <br /> <br />ATTEST: <br /> <br />CITY ATTORNEY <br /> <br /> <br />
