ORDINANCE NO. NS- 1659 <br />PAGE NINE <br /> <br />and in detail, for the proposed action. The <br />material on which the notice is based and which is <br />relied upon to support the reasons in that notice, <br />including, but not limited to, statements of wit- <br />nesses, documents, and investigative reports or ex- <br />tracts therefrom, shall be assembled and made avail- <br />able to the employee for his review and copying. <br />The notice shall inform the employee when and where <br />he may review such material. Material which cannot <br />be'disclosed to the employee may not be used to <br />support the reasons in the notice. <br /> <br /> SECTION 12. That section 9-118.4 of the Santa Ana <br />Municipal Code is hereby amended to read as follows: <br /> <br /> Sec. 9-118.4. Exceptions t6 the notice period <br /> and opportunity to answer. <br /> <br /> Advance written notice and opportunity to <br />answer are not necessary in the case of suspension, <br />dismissal or demotion of an employee for any rea- <br />son other than those grounds for disciplinary action <br />that are specified in section 9-118. <br /> <br /> SECTION 13. That the Santa Ana Municipal Code <br />hereby amended by adding a section to be numbered 9-119, <br />which section reads as follows: <br /> <br />Sec. 9-119. Layoffs. <br /> <br /> Ail layoffs within the competitive service <br />occasioned by the abolishment of a position, the <br />combination of duties of two (2) or more positions, <br />or the reduction in number of employees in a given <br />class shall be governed by seniority in service <br />and performance. Reemployment shall be in the re- <br />verse order of layoffs. <br /> <br /> SECTION 14. That section 9-118.7 of the Santa Ana <br />Municipal Code is hereby repealed. <br /> <br /> SECTION 15. This ordinance shall be effective if, <br />and only if, Proposition "S" is adopted by the voters of the <br />City of Santa Ana at the special municipal election on <br />November 2, 1982. <br /> <br /> SECTION 16.
