NS-1711 <br /> <br />AN URGENCY ORDINANCE OF THE CITY OF SANTA ANA <br />ADDING SECTION 14-12 TO THE SANTA ANA MUNICIPAL <br /> CODE TO REGULATE UNDERGROUND STORAGE OF <br /> HAZARDOUS MATERIALS <br /> <br /> THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES <br />ORDAIN AS FOLLOWS: <br /> <br /> SECTION 1: That the Santa Ana Municipal Code is <br />hereby amended by adding a section, to be numbered 14-12, <br />which said section reads as follows: <br /> <br />Sec. 41-1. Underground storage of hazardous <br /> materials. <br /> <br /> The Uniform Fire C~de is amended by adding Section <br />19.113 thereto, which said section reads as follows: <br /> <br /> Sec. 19.113. A permit shall be required for any <br />undergrQund storage tank, as defined in Section 25280 of the <br />Health and Safety Code of the State of California. Every <br />such underground storage tank shall conform to the require- <br />mentsjset forth in Sections 25284 and 25284.1 of the said <br />Health and Safety Code. <br /> <br /> SECTION 2: It is the intent of the Council in <br />adopting this ordinance to exempt the City of Santa Ana from <br />the provisions of Chapter 6.7 (commencing with Section <br />25280) of Division 20 of the Health and Safety Code of the <br />State of California, in accordance with Section 25288 of <br />said Chapter. <br /> <br /> SECTION 3: T~is ordinance is declared by the City <br />Council to be necessarY as an emergency measure for the <br />preserving the public peace, health, and safety. The <br />reasons for its urgency are as follows: <br /> <br /> 1. The Legislature of the State of Cali- <br />fornia has recently adopted a statute (1983) <br />Statutes, chapter 1046) which preempts local con- <br />trol over the regulation of underground storage <br /> <br /> <br />
