B. Institute an action for specific performance o~~' <br />this Agreement which, the parties hereby agree, shall be avail- <br />able notwithstanding (1) the availability of a remedy at law, <br />and (ii) any change in the applicable general or specific plan, <br /> <br />zoning, subdivision or 6uilding regulations <br />which alter or amend the rules, regulations <br />lng permitted uses of land, density, design, <br />construction <br />rive date of <br /> <br />adopted by the City <br />or policies govern- <br /> <br /> improvement or <br /> <br />standards and specifications in force on the effec- <br />this Agreement; and <br /> <br /> C. Pursue any other remedy permitted at law or in <br />equity; provided however, that no cause of action for damages <br />shall lie against either party to this Agreement as a consequence <br /> <br />of default. <br /> <br /> 20. Waiver.
