NS-1804 <br /> <br />~AN ORDINANCE OF THE CITY COUNCIL OF <br />THE CITY OF SANTA ANA AMENDING THE <br />SANTA ANA MUNICIPAL CODE BY ADDING <br />ARTICLE XIII TO CHAPTER 13 AND <br />CREATING THE CRIMINAL ACTIVITIES <br /> FUND <br /> <br /> THE CITY COUNCIL OF THE CITY OF SAN,TA ANA DOES ORDAIN <br />AS FOLLOWS: <br /> <br />SECTION 1: That th~ Santa Ana Municipal ~0de, is hereby <br />amended by adding an Article, to be numbered XIII, to Chapter 13, <br />which said article reads as follows: <br /> <br />ARTICLE XIIIo CRIMINAL'ACTIVITIES FUND <br /> <br />Sec. 13-120 Creation <br /> <br /> There is hereby created and established the "Criminal <br />Activities Fund" pursuant to the provisions of Section 11489 <br />of the California Health and Safety Code. <br /> <br /> Sec. 13-121 Deposits and expenditures <br /> <br /> Ail apportionments of moneys received pursuant to <br />California Health and Safety Code Section 11489 or any forfei- <br />ture disbursements made by the federal government shall be de- <br />posited in the Criminal Activities fund and shall be used <br />solely for investigation, detection and prosecution of crim- <br />inal activities. <br /> <br />SECTION 2: If any section, subsection, sentence, clause, <br />phrase or portion of this O~dinance is for any reason held to <br />be invalid or unconstitutuional by the decision of any court <br />or competent jurisdiction, such decision shall not affect the <br />validity of the remaining portions of this ordinance. The City <br />Council of the City of Santa Ana hereby declares that it would <br />have adopted this Ordinance and each section, subsection, <br />sentence, clause, phrase or portion thereof irrespective of the <br />fact that any one or more sections, subsections, sentences, <br />clauses, phrases, or portions be declared invalid or uncon- <br />stitutional. <br /> <br /> <br />
