REL:jd <br />1/21/86 (26) <br /> <br />ORDINANCE NO. NS-]838 <br /> <br />AN ORDINANCE OF THE CITY OF SANTA ANA AMENDING <br />SECTION 37-10 OF THE SANTA ANA MUNICIPAL CODE <br />AND'ADDING SECTION 37-10.5 THERETO, TO ALLOW <br />THE CITY TO PREPARE PROPERTY FOR THE RECEPTION <br />OF UNDERGROUND UTILITY LINES UPON THE FAILURE <br />OF THE PROPERTY OWNER TO DO SO, AND TO ASSESS <br />THE COST THEREOF AGAINST THE PROPERTY <br /> <br /> THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN <br />AS FOLLOWS: <br /> <br /> SECTION 1: That Section 37-10 of the Santa Ana Municipal <br />Code is hereby amended to read as follows: <br /> <br />Sec. 37-10. Responsibility of property owners. <br /> <br /> Every person owning, operating, leasing, <br />occupying or renting a building or structure <br />within a district shall construct and provide <br />that portion of the service connection on his <br />property between the facilities referred to in <br />section 37-9 and the termination facility on or <br />within said building or structure being served, <br />all in accordance with the applicable rules, <br />regulations and tariffs of the respective utility <br />or utilities on file with the commission. <br /> <br /> SECTION 2: That the Santa Ana Municipal Code is hereby <br />amended by adding a section, to be numbered 37-10.5, which said <br />section reads as follows: <br /> <br />Sec. 37-10.5 Remedies of the City on failure <br /> of property owner to act. <br /> <br /> (a) In the event a person owning, operating, <br />leasing, occupying or renting property within a <br />district does not comply with the provisions of <br />Section 37-10, the Executive Director of the Public <br />Services Agency shall give notice in writing to the <br />person in possession of such premises and a notice <br />in writing to the owner thereof, as shown on the <br />last equalized assessment roll, to provide the <br />required underground facilities within thirty days <br />after receipt of such notice. The notice to provide <br />the required underground facilities may be given <br /> <br /> <br />
