APPLICABILITY OF ORDINANCE <br />The specific development zoning district for the subject <br />property~ as authorized by Chapter 41, Division 26~ Sec. <br />41-595 e~. of the Santa Alia Municipal Code, is <br />specifi~ubject to the standards and regulations <br />contained in this plan for the express purpose of ' <br />establishini land use relulation and standards. All other <br />applicable chapters, articles and sections of the Santa <br />Aha Municipal Code shall apply unless expressly waived or <br />superseded by this ordinance. <br /> <br />2. PURPOSE <br />The SD 41 development plan consisting of standards and <br />regulat~ns is hereby established for the express purpose <br />of protecting the health, safety and general welfare of <br />the people of the City by promoting and enhancing the <br />value of properties and encouraging orderly development. <br /> <br />3. USES PERMITTED <br /> <br />The £ollowing use shall be permitted: <br /> <br />130 unit residential apartment complex. <br /> <br />4. BUILDING HEIGHT <br />No structure shall exceed $$ £eet within 15 feet of R1 <br />zoned property. Every structure in excess of 55 feet <br />shall provide an additional one'(l) foot setback to the <br />required buffer yards for each foot that the structure <br />exceeds 55 feet.
