359 <br /> <br />ORDINANCE NO. NS-1951 <br />PAGE THREE <br /> <br />SECTION 3: That section 7-8 of the Santa Ana Municipal Code <br />is hereby amended to read as follows: <br /> <br />Sec. 7-8. Prospective application. <br /> <br />(a) <br /> <br />The regulations imposed by this chapter shall apply to <br />structures and manufactured homes only if the start of <br />construction or substantial improvement occurs after <br />the effective date of this chapter. Any amendment to <br />such regulations shall apply only if the start <br />of construction occurs after the effective date of <br />such amendment. <br /> <br />(b) <br /> <br />"Start of construction" includes substantial improve- <br />ment, and means the date the buildinG permit was issued, <br />provided the actual start of construction, repair, <br />reconstruction, placement, or other improvement was <br />within 180 days of the permit date. The actual start <br />means either the first placement of permanent con- <br />struction on a site, such as the pourinG of slabs or <br />footings or any work beyond the stage of excavation; <br />or the placement of a manufactured home on a founda- <br />tion. "Permanent construction" does not include land <br />preparation, such as clearing, Grading, and filling; <br />nor does it include the installation of streets and/or <br />walkways; nor does it include excavation for a base- <br />ment, footings, piers or foundations or the erection <br />of temporary forms; nor does it include the instal- <br />lation on the property of accessory buildings, such <br />as garages or sheds not occupied as dwelling units or <br />not part of the main structure. <br /> <br />(c) <br /> <br />"Substantial improvement" is considered to occur when <br />the first alteration of any wall, ceilinG, floor or <br />other structural part of the building commences, <br />whether or not that alteration affects the external <br />dimensions of the structure. <br /> <br />SECTION 4: That section 7-21 of the Santa Ana Municipal Code <br />is hereby amended to read as follows: <br /> <br />Sec. 7-21. Permit requirement. <br /> <br />(a) <br /> <br />No building permit required by Article II of Chapter 8 <br />of this Code shall be issued for any new construction <br />or other development in the A, AO, AH, A7, A8 or Al6 <br />zones which fails to comply with the requirements of <br />this chapter. <br /> <br /> <br />
