The form and content of the waiver <br /> application and appeal application shall be determined <br /> by the Executive Director of the Planning and Building <br /> Safety Agency. <br /> <br /> (d) For existing single-family and duplex (2 units) struc- <br /> tures, a waiver as outlined in subsection (c) may be <br /> granted for expansion of the existing structures, pro- <br /> vided no additional dwelling units are created. <br /> <br /> (e) In addition to the waiver provisions of this section, <br /> minor exceptions may be granted from the requirements <br /> of subsection (a) of this section subject to the stan- <br /> dards set forth in section 41-638. <br /> That section 34-84 of the Santa Ana Municipal Code <br /> amended to read as follows: <br /> <br /> Sec. 34-84. Same - Waiver May Be Granted. <br /> <br /> The requirements of section 34-82 or section 34-83 may <br />be waived by the granting of a minor exception for such purpose <br />pursuant to Article V of Chapter 41 of this Code. <br />SECTION 3: That sections 8-747 and 34-85 of the Santa Ana <br />Municipal Code are hereby repealed. <br />SECTION 4: If any section, subsection, sentence, clause, <br />phrase or portion of this ordinance is for any reason held to <br />be invalid or unconstitutional by the decision of any court <br />of competent jurisdiction, such decision shall not affect the <br />validity of the remaining portions of this ordinance. The City <br />Council of the City of Santa Ana hereby declares that it would <br />have adopted this ordinance and each section, subsection, sentence, <br />clause, phrase or portion thereof irrespective of the fact that <br />any one or more sections, subsections, sentences, clauses, phrases, <br />or portions be declared invalid or unconstitutional. <br /> SECTION 5: Neither the adoption of this ordinance nor the <br /> repeal hereby of any ordinance shall in any manner affect the <br /> prosecution for violation of ordinances, which violations were <br /> committed prior to the effective date hereof, nor be construed <br /> as affecting any of the provisions of such ordinance relating <br /> to the collection of any such license or penalty or the penal <br /> <br />SECTION 2 <br />is hereby <br /> <br /> <br />
