NS-1975 <br /> <br />AN ORDINANCE OF THE CITY OF SANTA ANA AMENDING <br />SECTION 13-121 OF THE SANTA ANA MUNICIPAL CODE <br />RELATING TO DEPOSITS AND EXPENDITURES OF THE <br />CRIMINAL ACTIVITIES FUND. <br /> <br /> THE CITY COUNCIL OF THE CITY OF SANTA ANA DOES ORDAIN <br />AS FOLLOWS: <br /> <br />SECTION 1: That section 13-121 of the Santa Ana Municipal <br />Code is hereby amended to read as follows: <br /> <br />Sec. 13-121. Deposits and Expenditures <br /> <br /> Ail apportionments of monies received pursuant to <br />California Health & Safety Code Section 11489 or any <br />forfeiture disbursements made by the federal government <br />shall be deposited in the Criminal Activities Fund and <br />shall be used solely for investigation, detection and <br />prosecution of criminal activities. Further, any monies <br />which were or were intended to be used as evidence in a <br />criminal prosecution and which have not been claimed, <br />may, after one year from the final disposition of the <br />matter at the trial court level, be transferred into the <br />Criminal Activities Fund, and in the event that a valid <br />claim for any monies so deposited is thereafter pre- <br />sented, such claim may be paid from the Criminal Activi- <br />ties Fund. <br /> <br />SECTION 2: If any section, subsection, sentence, clause, <br />phrase or portion of this ordinance is for any reason held to <br />be invalid or unconstitutional by the decision of any court of <br />competent jurisdiction, such decision shall not affect the <br />validity of the remaining portions of this ordinance. The City <br />Council of the City of Santa Ana hereby declares that it would <br />have adopted this ordinance and each section, subsection, sentence, <br /> <br /> <br />
