NS-2031 <br /> <br />AN ORDINANCE OF THE CITY OF SANTA ANA REZONING <br />CERTAIN PROPERTY LOCATED ON THE EAST SIDE OF THE <br />SANTA ANA FREEWAY BETWEEN FIRST AND FOURTH <br />STREETS FROM THE P (PROFESSIONAL) DISTRICT TO <br />THE SD (SPECIFIC DEVELOPMENT) DISTRICT, ADOPTING <br />SPECIFIC DEVELOPMENT PLAN NO. 54 FOR SAID PROPERTY, <br />AND APPROVING A DEVELOPMENT AGREEMENT BETWEEN THE <br />CITY OF SANTA ANA AND BIRTCHER XEROX PARTNERS PER- <br />TAINING TO SAID PROPERTY. <br /> <br /> WHEREAS, Amendment Application No. 1031 has been <br />filed with the City of Santa Ana to change the zoning dis- <br />trict designation of certain real property located generally <br />on the east side of the Santa Ana Freeway between First and <br />Fourth Streets in the City of Santa Ana, and more specifically <br />delineated in Exhibit A, attached hereto and incorporated <br />herein by reference, from the P (Professional) District to the <br />SD (Specific Development) district, and to adopt a Specific <br />Development Plan No. 54, in the form set forth in Exhibit B, <br />attached hereto and incorporated herein by reference, for <br />said property; and <br /> <br /> WHEREAS, the applicant Birtcher Xerox Partners pro- <br />poses to develop said property in accordance with Specific <br />Development Plan No. 54 and in this regard has requested to <br />enter into a Development Agreement in the form set forth in <br />Exhibit C, attached hereto and incorporated herein, with the <br />City of Santa Ana, in accordance with sections 65864-65869.5 <br />of the Government Code of the State of California; and <br /> <br /> WHEREAS, the Planning Commission of the City of Santa <br />Ana held a duly noticed public hearing on August 14, 1989, <br />on the said Amendment Application, Specific Development Plan, <br />and the Development Agreement, and, based thereon, determined <br />that the development as proposed therein is consistent with <br />the general plan of the City of Santa Ana, and recommended <br />that the City Council approve the Amendment Application, Specific <br />Development Plan No. 54, and the Development Agreement; and <br /> <br /> WHEREAS, prior to taking action on this ordinance, <br />the City Council of the City of Santa Ana has reviewed and <br /> <br /> <br />
