267 <br /> <br />benefit received by parcels of real property, the cost of providing facilities and/or services <br />available to each parcel, or any other reasonable basis as determined byShe City Council. <br />A special tax apportioned on any of these bases shall not be construed to be on or based <br />upon the ownership of real property. <br /> <br />Section 20-30. Noncontiguous areas; alteration of boundaries. <br /> <br /> (a) A community facilities district may include areas of territory that are <br />not contiguous. <br /> <br /> (b) In establishing the boundaries of the district, the City Council may <br />alter the exterior boundaries of the district to include less territory than that <br />described in the recorded boundary map but it may not include any territory not <br />described in that map. <br /> <br />Section 20-31. Boundaries of district; inclusion of lands devoted to agricultural, <br />timber or livestock uses. <br /> <br /> Land devoted primarily to agricultural, timber, ~r livestock uses and being used <br />for the commercial production of agricultural, timber'S'or livestock products may be <br />included in a community facilities distric~ only if such land is contiguous to other land <br />which is included within the described exterior boundaries of the community facilities <br />district, and only if the legislative body finds that the land will be benefited by any of the <br />types of public facilities and services proposed to be provided within the district. The <br />land may, however, be included in the community facilities district, if the owner requests <br />its inclusion. <br /> <br />Section 20-32. Establishment or changing appropriations limit; election on <br />propositions, adjustment. <br /> <br /> The City Council may submit a proposition to establish or change the <br />appropriations limit, as defined by subdivision (h) of Section 8 of Article XIII B of the <br />California Constitution, of a community facilities district to the qualified electors of a <br />proposed or established district. The proposition establishing or changing the <br />appropriations limit shall become effective if approved by the qualified electors voting on <br />the proposition and shall be adjusted for changes in the cost of living and changes in <br />populations, as defined by subdivisions (b) and (c) of Section, 7901, except that the <br />change in population maybe estimated by the legislative body in the absence of an <br />estimate by the State of California Department of Finance, and in accordance with <br />Section I of Article XIII B of the California Constitution. For purposes of adjusting for <br />changes in population, the population of the district shall be deemed to be at least one <br />person during each calendar year. <br /> <br />Section 20-33.
