48':) <br /> <br />Developer acquires legal title to the Site pursuant to the <br />DDA, Developer shall so notify City, and City shall cause a <br />copy of this Agreement to be recorded against the Site in <br />accordance with Government Code Section 65868.5. <br /> <br /> D. Amendment of Agreement. This Agreement may be <br />amended from time to time by mutual consent of City and <br />Developer in accordance with the provisions of Government <br />Code Sections 65867 and 65868 and pursuant to the procedures <br /> <br />set forth in Article 7 of the Procedures <br />Consideration of Development Agreements of <br />Ana. <br /> <br /> E. Term. <br /> <br />and Requirements for <br /> <br /> the City of Santa <br /> <br />(1) <br /> <br />The term of this Agreement shall commence upon <br />the Effective Date and shall expire five (5) <br />years thereafter, unless sooner terminated as <br /> <br /> provided in this Agreement. <br /> <br />(2) Upon the expiration or termination of this <br /> Agreement for any reason as to the Site, the <br /> City and Developer agree to cooperate and <br /> execute any document reasonably requested by <br /> the other party to remove this Agreement of <br /> record. <br /> <br />Cooperation in the Event of Legal Challenge. <br /> <br />(1) In the event of any legal action instituted by <br /> any third party challenging the validity or <br /> enforceability of any provision of this <br /> <br />2/23/90 <br /> <br />-18- <br /> <br /> <br />
