551, <br /> <br />ORDINANCE NS-2061 <br /> <br />TAT/meg-35 <br />4/30/90 <br /> <br />AN ORDINANCE OF THE CITY OF SANTA <br />ANA AMENDING SECTION 10-150 OF THE <br />SANTA ANA MUNICIPA~ CODE PERTAINING <br />TO THE EXHIBITION OF HARMFUL MATTERS <br />TO MINORS AND BLINDER RACKS <br /> <br /> The City Council of the City of Santa Ana does ordain as <br />follows: <br /> <br /> SECTION 1. That section 10-150 of the <br />Code is hereby amended to read as follows: <br /> <br />"Sec. 10-150. Exhibition of harmful <br /> blinder racks. <br /> <br />Santa Ana Municipal <br />matter to minors; <br /> <br /> (a) Any newspaper or similar publication which <br />displays material which is harmful to minors, as defined <br />in Section 313 of the Penal Code of the State of <br />California, in a public place, other than a public place <br />from which minors are excluded, shall have the placement <br />of devices commonly known as blinder racks in front of <br />the material so that the lower two-thirds of the <br />material is not exposed to view. <br /> <br /> (b) Every person is guilty of a misdemeanor who <br />causes, permits, procures, counsels or assists in an <br />offer of sale of any newspaper or similar publication in <br />violation of this section. <br /> <br /> (c) Any newspaper or similar publication offered <br />for sale in violation of this section constitutes a <br />public nuisance. <br /> <br /> SECTION 2. If any section, subsection, sentence, clause, <br />phrase or portion of this ordinance is for any reason held to be <br />invalid or unconstitutional by the decision of any court of <br />competent jurisdiction, such decision shall not affect the <br />validity of the remaining portions of this ordinance. The City <br />Council of the City of Santa Ana hereby declares that it would <br />have adopted this ordinance and each section, subsection, <br />sentence, clause, phrase or portion thereof irrespective of the <br />fact that any one or more sections, subsections, sentences, <br />clauses, phrases, or portions be declared invalid or <br />unconstitutional. <br /> <br /> SECTION 3. Neither the adoption of this ordinance nor the <br />repeal hereby of any ordinance shall in any manner affect the <br />prosecution for violation of ordinances, which violations were <br />committed prior to the effective date hereof, nor be construed as <br />affecting any of the provisions of such ordinance relating to the <br /> <br /> <br />
