CALIFORNIA <br /> <br />-122 PM MAR 8 '91 <br />4 a'~AECORDr:F <br /> <br />DEVELOPMENT AGREEMENT <br /> <br />THIS DEVELOPMENT AGREEMENT (the "Development Agreement") <br />is made and entered into this 7th day of January, 1991, by and <br />between the CITY OF SANTA ANA, a municipal corporation organized <br />and existing under the laws of the State of California (the <br />"city"), and PACTEL PROPERTIES, a California corporation <br />("Developer"). <br /> <br />R Eel TAL s: <br /> <br />A. California Government Code Section 65864 , et seq., <br />provides that the legislative body of a city may enter into a <br />development agreement for the development of real property in order <br />to vest certain rights in the developer and to meet certain public <br />purposes of the local government. Pursuant to California <br />Government Code section 65865, the City has adopted its Resolution <br />No. 82-98 ("Resolution No. 82-98"), establishing procedures and <br />requirements for the approval of development agreements. Developer <br />has applied to the City pursuant to California Government Code <br />Sections 65864 - 65869.5 and pursuant to said Resolution for <br />approval of the Development Agreement set forth herein . <br /> <br />B. The Developer and the City desire to enter into this <br />Development Agreement in order to facilitate the development of <br />certain property (the "Property") within that commercial/retail <br />development known as "Hutton Centre" which Property and Development <br />are more fully described in Exhibit "A" and shown on the map set <br />forth on Exhibit "B", both attached hereto. The proposed <br />development of the Property ("the Development") consists of the <br />construction of an office building of not more than ten stories <br />(the "Office Building") and a parking structure of not more than <br />eight levels (the "Parking Structure"). Developer is the owner of <br />the Property. <br /> <br />C. The City has conducted duly noticed public hearings <br />on this proposed Development Agreement pursuant to Government Code <br />Section 65867 and Resolution No. 8298 and has found that the <br /> <br />1 <br />
